United Air Lines, Inc., requests a statement of authorization under 14 C.F.R. Part 212 to display the designator code of Compania Mexicana de Aviacion, S.A. de C.V., on a blind sector basis, on United's flights between Chicago, Illinois, and London, United Kingdom. In support of its application, United submits the following:
Mexicana proposes to offer new service between points in Mexico and London via Chicago. Passengers on Mexicana's flights between points in Mexico and Chicago, or carried as code-share passengers on United's Mexico City-Chicago flights, will connect to United's nonstop flights between Chicago and London. United will display Mexicana's designator code on the flights, enabling Mexicana to offer Mexico-London online connecting service.
Mexicana's code will be displayed on United's Chicago-London flights only on a blind-sector basis for Mexicana traffic moving between Mexico and London. Mexicana will not sell service under its own designator code to local Chicago-London traffic.
United understands that Mexicana does not require a Part 216 authorization to offer services over the routing described herein. This understanding is based upon previous discussions between Mexicana's counsel and DOT staff. Should it be determined, in light of this application, that such a Part 216 authorization is required, then United urges that the authorization be issued to Mexicana sua sponte to the extent necessary to hold out the Mexico-U. S. -London code-share service as proposed herein. American Airlines, Inc. hereby answers in opposition to the captioned application filed on May 17, 2001 by United Air Lines, Inc. seeking authorization to display the designator code of Compania Mexicana de Aviacion, S.A. de C.V., on a blind sector basis, on United's flights between Chicago and London (Heathrow). The Department should deny this latest effort by the Star Alliance to consolidate their services at Heathrow Airport.

By its Answer, American once again seeks to leverage approval of its own highly controversial code share with British Airways by objecting to an unrelated and non-controversial code share application of other carriers which raises no comparable issues. United by its application in this proceeding seeks to display the code of Compania Mexicana de Aviacion, S.A. de C.V. ("Mexicana") on United's Chicago O'Hare- London Heathrow flights. This code share would be used to carry passengers ticketed by Mexicana between Mexico City and London. As United explained in its application, this code share is fully consistent with aviation relations between the U.S.

Re: Joint Notification of Termination of Codeshare and Regulatory Cooperation Agreement
In accordance with the terms of the Department of Transportation's approvals of the statements of authorization in the above‑captioned dockets, Compania Mexicana de Aviacion, S.A. de C.V. and United Air Lines, Inc. hereby notify the Department of the expiration of their Codeshare and Regulatory Cooperation Agreement effective November 15, 2003. As a result of the Agreement's expiration, all codeshare services operated by Mexicana and United will be discontinued effective March 31, 2004, and the related statements of authorization cease to be effective after that date. This notice applies only to the statements of authorization issued in the above referenced dockets and not to any exemptions granted to United or Mexicana in those dockets or any other docket.
