By Order 84-4-47 issued by the Civil Aeronautics Board on April 13, 1984, the Board last determined essential air service (EAS) for Lawton/Ft. Sill as at least two daily nonstop roundtrips to Dallas/Ft. Worth providing in the aggregate at least 80 available seats inbound and 80 available seats outbound if aircraft of nine or fewer seats are used and 62 seats in each direction if aircraft with 14 or more seats are used. Lawton/Ft. Sill currently receives service from American Eagle, in addition to ASA. After ASA's termination of service, Lawton/Ft. Sill will continue to receive substantially more than the level of service established by the Department as essential. Based on the latest information available, American Eagle will serve Lawton/Ft. Sill with six daily nonstop round-trip flights to and from American's major hub at Dallas/Ft. Worth with at least 204 seats each way each weekday.

Attachments 1 and 2 provide a detailed description of the service by ASA and American Eagle at Lawton/Ft. Sill for the May 1, 2001 and August 1, 2001 schedules (before and after ASA's termination, respectively, assuming no change to American Eagle's schedules). As these attachments demonstrate, Lawton/Ft. Sill will continue to receive levels of service that significantly exceed the city's EAS requirements after ASA's service is terminated. Accordingly, there is no basis in law or policy for the Department to prevent ASA from terminating service after July 3 1, 200 1.

Before terminating its service to and from Lawton/Ft. Sill, ASA or Delta will contact all passengers holding reservations on the discontinued flights to notify them of the termination of ASA's service and to assist them in arranging alternative transportation.
