DaimlerChrysler Aviation GmbH, a wholly owned subsidiary of DaimlerChrysler Mobilien GmbH, which itself is a 100% subsidiary of DaimlerChrysler AG, (a corporation organized under the laws of the Federal Republic of Germany), manages and operates corporate jet aircraft that are owned by DaimlerChrysler AG. DaimlerChrysler Aviation GmbH holds an Air Operator Certificate and Operations Specifications issued by the Federal Republic of Germany. DaimlerChrysler Aviation GmbH currently operates 2 Challenger 604 aircraft, 2 Learjet 60 aircraft, and one Airbus A319CJ (equipped with 48 seats), which are primarily used to transport DaimlerChrysler AG employees and business associates on noncommon carriage flights for company business purposes.' In addition to operating noncommercial flights to support the company's business requirements, DaimlerChrysler Aviation GmbH uses the Challenger 604 and Learjet 60 aircraft (but not the Airbus A3190) to provide ad hoc commercial charter air services for compensation and hire to third party customers when the aircraft are not being used for DaimlerChrysler AG business purposes.
DaimlerChrysler Aviation GmbH intends to operate the A319CJ primarily between Stuttgart, Germany and Pontiac, Michigan in the United States on four roundtrip flights each week to transport DaimlerChrysler AG employees and other persons required for DaimlerChrysler AG business purposes between the company's two Headquarters. There will be no remuneration or compensation by employees or third parties for these flights. Although DaimlerChrysler Aviation GmbH currently intends to use the Airbus A319CJ exclusively for intra-company business purposes, there may be times in the future when third party passengers are charged for travel onboard the aircraft. As such, the Applicant seeks authorization from the DOT that would permit such operations.
In December 2001, DaimlerChrsyler Aviation GmbH intends to add a factory-new Bombardier Global Express BD-700- IA10 to its fleet, also to be primarily used for intra-corporate business purposes. The Global Express will be German registered, and owned by DaimlerChrysler AG.

By Notice of Action Taken dated July 10, 2001 in the captioned docket, the Department issued DaimlerChrysler Aviation GmbH an exemption to provide charter foreign air transportation of persons, property and mail (1) between points in the Federal Republic of Germany and the United States; and (2) between points in the United States and points in third countries as authorized by and in accordance with the Air Transport Agreement between the Governments of the United States and the Federal Republic of Germany. The Department also granted a waiver, to the extent necessary, of the requirement that DaimlerChrysler Aviation GmbH be effectively owned and controlled by citizens of its licensing homeland. The Department found that such action was consistent with the U.S.-Germany open skies agreement and U.S. aviation policy interests.

By Notice of Action Taken dated October 22, 2002 in the captioned docket, the Department renewed the exemption authority issued to DaimlerChrysler Aviation GmbH to continue to conduct (1) charter operations, carrying persons, property and mail, between any point or points in Germany and any point or points in the United States; and between any point or points in the United States and any point or points in a third country or countries, provided that, except with respect to cargo charters, such service constitutes part of a continuous operation, with or without change of aircraft, that includes service to Germany for the purpose of carrying local traffic between Germany and the United states; and (2) other charter operations pursuant to 14 CFR Part 212.

DaimlerChrysler Aviation GmbH hereby applies, pursuant to 49 U.S.C. § 40109 and Subpart C of the Department's Rules of Practice in Proceedings, for renewal of an exemption from 49 U.S.C. § 41301 to permit the applicant to continue to conduct (1) charter operations, carrying persons, property and mail, between any point or points in Germany and any point or points in the United States; and between any point or points in the United States and any point or points in a third country or countries, provided that, except with respect to cargo charters, such service constitutes part of a continuous operation, with or without change of aircraft, that includes service to Germany for the purpose of carrying local traffic between Germany and the United States; and (2) other charter operations pursuant to 14 C.F.R. Part 212.
The authority for which renewal is requested was last granted on January 19, 2005, for a period of two years.
