US Airways intends to inaugurate nonstop service in March 2002 between Washington, D.C., and Bermuda. US Airways would be a new entrant in the Washington, D.C.-Bermuda market. No carrier currently offers nonstop Washington, D.C-Bermuda service. Accordingly, US Airways' proposed service will bring substantial and immediate benefits to Washington, D.C. passengers, supporting commerce and tourism in this market, and enhancing options available to consumers and the traveling public. US Airways' proposed service will also provide convenient, on-line connecting service to Bermuda from a large number of communities in the eastern United States served by US Airways from Washington, D.C.

US Airways plans to operate its scheduled daily nonstop service between Washington, D.C., and Bermuda on a year-round basis commencing in March 2002. For this service, US Airways plans to utilize Airbus 319 and/or Airbus 320 aircraft, currently in its fleet, with 120 or 142 seats configured in a two class configuration. A route map illustrating the proposed service and a proposed, illustrative service schedule are attached as Exhibit BDA-A. The anticipated annual operating statistics and fuel consumption estimates are attached as Exhibit BDA-B.

The U.S.-U.K. Air Services Agreement, as amended, provides for the authority sought in this Application. Pursuant to that Agreement, U.S. carriers can serve Bermuda from several points, including Washington, D.C. (U.S. Route 4.) US Airways proposes service between Ronald Reagan Washington National Airport (DCA) and Bermuda, beginning in March 2002. In the wake of September 11, DCA is a restricted airport, and service to a number of domestic cities has not yet been restored, due to a shortage of sky marshals and other factors. In these circumstances, the Department should not authorize service between DCA and a foreign point such as Bermuda until all of the service to U.S. cities that DCA lost as a result of September 11 is back in operation. American would have no objection to the award of authority to US Airways to serve Bermuda through Washington (Dulles) or Baltimore.

Restoration of domestic DCA service schedules should take precedence over DCA-Bermuda service. Delta would have no objection to US Airways providing Washington - Bermuda service from Washington Dulles International Airport or from Baltimore/Washington International Airport. Indeed, as noted in the exemption application, US Airways already holds certificate authority for Baltimore. US Airways successfully served Bermuda nonstop from the Baltimore/Washington International Airport for many years, prior to the recent suspension of that flight.

American and Delta - two carriers that do not even serve the Washington, D.C.-Bermuda market - attempt to arrogate to themselves the critical decisions about what service patterns should be operated at Ronald Reagan Washington National Airport ("DCA") in the post-September 11 operating environment. In their meddlesome answers, both American and Delta oppose US Airways' Washington, D.C.-Bermuda exemption application on the ground that service between DCA and Bermuda, a foreign point, should not be authorized until all of the pre-September 11 service to U.S. cities from DCA is restored. (Answer of American (Dec. 20, 2001), at 1; Answer of Delta (Dec. 21, 2001), at 2.) While they are entitled to their view, American's and Delta's opposition to US Airways' application has no basis. The Department should reject the positions taken by American and Delta, and should move expeditiously to awarding the requested authority to US Airways.

Notice of Action Taken Washington Reagan National - Bermuda

Scheduled foreign air transportation of persons, property and mail between Washington DC and Bermuda.  

American and Delta oppose the application since it contemplates service from Ronald Reagan Washington National Airport (DCA). This airport, according to American and Delta, has been restricted since September 11, and service to a number of domestic U.S. cities has not yet been restored due to a shortage of sky marshals and other factors. In these circumstances, American and Delta argue that the Department should not authorize international leisure service from DCA until the previous DCA domestic services have been restored.

In its reply, US Airways argues that its proposed service will help to implement the full extent of US Airways' operations at DCA, thereby contributing to the reopening and recovery of DCA; provide consumer benefits for U.S. - Caribbean service travelers; and generate economic benefits for the entire Washington DC metro area, plus the surrounding region.

With regard to the submissions of American and Delta, we note that the Department has now announced that, as of April 15, 2002, flight operations at Ronald Reagan Washington National Airport were authorized to return to their pre-September 11 capacity. Against this background, we have decided to grant the requested exemption authority.

Applies for renewal of its exemptions to engage in scheduled foreign air transportation of persons, property, and mail between Washington, DC, and Bermuda (Docket OST-01-11152, NOAT issued April 18, 2002), and between Charlotte, NC, and Bermuda (Docket OST-96-1839, NOAT issued July 22, 2002). In addition, US Airways requests that the Department give these two exemption authorities a common expiration date to run concurrently with its other Bermuda exemption authority (Docket OST-03-14671, NOAT issued March 18, 2003 (FLL-BDA)), and, to the extent permitted, consolidate these Bermuda exemption authorities into one of these dockets.

Application to Amend an Exemption

Pursuant to 49 U.S.C. 40109 and Subpart C of the Department’s Rules of Practice (14 C.F.R. Part 302), US Airways, Inc. hereby applies to amend its current exemption in this docket and, to the extent necessary, for a designation so that it may operate scheduled foreign air transportation of persons, property, and mail between Chicago, Illinois, and Bermuda. Although US Airways plans at this time to offer this Chicago-Bermuda service on a code-share basis with United, US Airways may, in the future, operate its own services in this market as opportunities present themselves.

US Airways holds various certificates of public convenience and exemption authorities, including authority to serve Bermuda from Baltimore, Boston, New York-Newark, Philadelphia, Charlotte, Ft. Lauderdale, Washington, DC, and Orlando. DOCKET OST-96-1839 - Scheduled foreign air transportation of persons, property and mail between Charlotte, North Carolina, and Bermuda (renewal of existing authority).

US Airways requests that the exemption authorities described above be issued with a common expiration date to run concurrently with its other Bermuda exemption authority in Docket OST-03-14671, set to expire on March 18, 2005.  US Airways also requests that these Bermuda exemption authorities be consolidated into one of the referenced dockets.

US Airways amended its application in Docket OST-01-11152 by requesting new authority between Chicago and Bermuda. US Airways states that it plans to provide service between Chicago and Bermuda under a code-share arrangement with United Air Lines.  However, US Airways states that it wants the opportunity to provide service to this Bermuda market either directly or through a code-share arrangement.

We have granted the carrier’s request to consolidate the exemption authority granted here into Docket OST-01-11152.  Thus, the carrier may henceforth file in Docket OST-01-11152 at such time as it seeks to make requests concerning its exemption authority to serve the Charlotte/Chicago/Washington-Bermuda markets.

US Airways currently provides scheduled air service between Washington, DC, and Bermuda using Airbus A‑3191320 aircraft. US Airways provides Summer­ season scheduled air service between Charlotte, North Carolina, and Ft. Lauderdale, Florida, and Bermuda. Although US Airways does not currently provide scheduled air service between Chicago, Illinois, and Bermuda, renewal of US Airways' authority will provide US Airways with the greatest flexibility to implement air service, either with its own aircraft, or via code‑sharing, if future market conditions should warrant.
