Since October 1999, ACA has operated two daily roundtrip flights mbetween Chicago and Mobile using regional jet aircraft. The slots for those flights at O'Hare Airport were initially granted by an exemption under 49 U.S.C. §41714. Order 99-7-17. One of those flights continues to be operated using an exemption slot at O'Hare granted to ACA. The joint applicants have determined that, regrettably, the Chicago Mobile service must be eliminated as part of that emergency rationalization process. Such service reductions are necessary in order to protect against further job losses and enable the joint applicants to recover from the disastrous consequences of the recent tragic events. It would impose a considerable additional hardship if United and ACA 3 ACA also plans to terminate its service between Mobile and Washington Dulles at the same time. That service is not subject to notice requirements under either §41717 or §41719 because it does not operate with exemption slots at any airport and Mobile is a small hub airport.

Enclosed please find a copy of a letter from the Mobile Airport Authority to Atlantic Coast Airlines with a copy to United relating to the above-referenced joint application. In that letter, the Airport Authority states its non-objection to the requested waiver and early termination of service delay.

Order Allowing Early Suspension of Service | Waiver of Notice and Early Termination of Service at Mobile, Alabama |
We have decided to grant the joint
applicants' request to suspend service. Additionally, we note that the community
has affirmatively stated that it has no objection to the early suspension.
Finally, we note that Mobile will continue to receive nonstop jet service to
Atlanta, Charlotte, Cincinnati, Dallas/Ft. Worth, Houston, and Memphis by four
different carriers.
