Prior to ACA commencing service between Staunton and Dulles in April, 2000, the Commission and the community at large expended significant amounts of time and financial resources to attract a carrier to provide service to Washington, D. C. Since April, 2000, ACA has previously obtained a 50% load factor on its flights despite disadvantages such as United Airlines' labor issues during the summer of 2000. Since September 23, 200 1, ACA has averaged a 61% load factor on its 2 -20 p.m. departure and a 17% load factor on its 7:2 5 p.m. departure despite its poorly timed departure.
The Commission also believes that ACA is obligated to maintain service to the Airport pursuant to the Air Transportation Safety and System Stabilization Act, Public Law 107-42 (the "Act"). Section 105A of such Act provides that "The Secretary of Transportation should take appropriate action to insure that all communities that had scheduled air service before September 11, 2001, continue to receive adequate air transportation service and that essential air service to small communities continues without interruption." Section 105(c) of the Act authorizes the Secretary to require an air carrier receiving direct financial assistance under the Act to maintain scheduled air service to any point serviced by that carrier before September 11, 200 1. As of October 5, 200 1, Atlantic Coast Airlines had received payments totaling $5,722,621 and United Airlines, Inc. had received $390,671,788 in payments made in accordance with Sections 101 and 103 of the Act.
