The Joint Applicants intend to institute nonstop Mexico City/Hermosillo-Salt Lake City service on or about December 10, 2001. In order to allow sufficient time to prepare for the startup dates and promote the services, the Joint Applicants request that the Department act expeditiously on this application and without awaiting the completion of the 15-day answer period; the Joint Applicants will poll U.S. carriers as to their position on the applications and report the results to the Department.

By this exemption request, Aeromexico seeks authority to engage in scheduled foreign air transportation of persons, property and mail between Mexico City and Hermosillo, Mexico and Salt Lake City, Utah. Aeromexico initially will provide two weekly nonstop round-trips with MD-80/87 aircraft on each route. Northbound Mexico City-Salt Lake City flights will depart on Fridays and Saturdays, with southbound flights departing on Saturdays and Sundays. Hermosillo-Salt Lake City round trips will be operated on Mondays and Fridays. Aeromexico also proposes to carry Delta’s "DL" code on the described flights as well as any other flights Aeromexico may operate in the markets.

There currently is no round trip single plane service in either the Mexico City-Salt Lake City or Hermosillo-Salt Lake City market. Official Airline Guide, July 15, 2001. Grant of the requested exemption will enable Aeromexico to institute nonstop service on these routes and, thus, generate substantial service benefits in the Mexico-U.S. market for the traveling public. In addition, grant of Delta’s application for Mexico City/ Hermosillo-Salt Lake City authority and Aeromexico’s application for a statement of authorization will enable Delta to offer additional competitive options to travelers in these markets.

By Notice of Action Taken, dated August 22, 2001, the Department granted Aeromexico's exemption application to engage in scheduled foreign air transportation of persons, property and mail between Mexico City and Hermosillo, Mexico, on the one hand, and Salt Lake City, Utah, on the other. The authority currently is due to expire on August 22, 2002. Aeromexico is serving the Mexico City-Salt Lake City market with two weekly nonstop MD-87 round trips and the Hermosillo-Salt Lake City market with three weekly nonstop round trips with MD-87 aircraft. It also carries the designator code of Delta Air Lines, Inc., on those flights. Aeromexico desires to continue to serve the markets and, therefore, seeks renewal of the exemption authority. The service being offered by Aeromexico in these markets has resulted in significant travel benefits for the public and renewal of the authority clearly is in the public interest.

Application Renewal of Exemptions

This renewal application encompasses multiple docketed exemptions that Delta relies upon to provide nonstop U.S.-Mexico services either with its own aircraft or pursuant to a codeshare arrangement with Aerovias de Mexico, S.A. de C.V. The exemptions in the captioned dockets all have renewal application deadlines within the next several months. Delta requests that these exemptions be renewed for a period of at least two years, with a common expiration date, or until 90 days after the Department's final determination on applications for certificate authority with respect to each route, whichever occurs earlier. The establishment of a common renewal date will promote administrative efficiency and reduce the burden on Delta and the Department in maintaining these multiple and non-controversial U.S.-Mexico exemption authorities.

The U.S.-Mexico transborder exemption authority granted to Delta in the captioned dockets is subject to the dormancy notice requirements set forth in condition 7 of Appendix A of Order 88-10-2. With the exception of the U.S.-Mexico exemption authority granted in Dockets OST-2001-10457, OST-2000-7390, and OST-2000-7022, the U.S.-Mexico exemption authority granted is limited to services provided on a code-share basis only.

Delta does not seek to renew the Los Angeles-Durango exemption authority originally granted in this docket (see Notice of Action Taken dated June 20, 2000). Delta provides seasonal service in the Atlanta-San Jose del Cabo market.

By this application, Aeromexico seeks renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property and mail between Mexico City and Hermosillo, Mexico, on the one hand, and Salt Lake City, Utah, on the other. The exemption authority was last renewed by Notice of Action Taken, dated October 20, 2004, and currently is due to expire on October 20, 2005. Although Aeromexico currently is serving the route by connecting service, it previously offered nonstop service in the market and would like to retain the authority so it can resume such service when warranted by traffic conditions.

Dormany Notices and Notices of Cessation of Codesharing

Delta Air Lines, Inc. hereby notifies the Department of the dormancy of the following routes:

  1. New York/Newark-Acapulco (Docket OST-2005-22243). Delta's final scheduled flight on this route took place on March 31, 2007.
  2. Atlanta-Merida (Docket OST-2005-22243). Delta does not intend to resume seasonal Atlanta-Merida service with its own aircraft during peak periods, but plans to continue to serve this route on a codeshare basis with Delta Connection carrier Atlantic Southeast Airlines, Inc. Accordingly, Delta hereby requests that its designation be converted to a codeshare-only authorization.
  3. Atlanta-Ixtapa/Zihuatanejo (Docket OST-2005-22620). By letter dated October 17, 2006, Delta notified the Department that the Atlanta-Ixtapa/Zihuatenejo route would be transitioned to seasonal service. Delta has now determined that it will not resume peak season service on this route.

Delta also hereby notifies the Department that its "DL*" designator code will no longer be displayed on Aeromexico flights on the following U.S.-Mexico routes:

  1. Las Vegas-Hermosillo (Docket OST-2000-7022);
  2. Salt Lake City-Hermosillo (Docket OST-2001-10438);
  3. Salt Lake City-Mexico City (Docket OST-2001-10438);
