OST-01-10400 August 14, 2001 Application for an Exemption Exemption - U.S.- Brazil All-Cargo

When it applied for the broadened authority conferred by Order 2001-7-13, Atlas explained that the previously strong U.S.-Brazil airfreight market was in significant decline and that the flexibility sought would assist Atlas by allowing the carrier to combine Brazil traffic flows.  In the intervening months, the market has shown few signs of improvement.  Recently, Atlas received requests from potential customers for airfreight service between Miami, on the one hand, and Curatiba and Fortaleza, Brazil, on the other. It would like to be able to serve those points in combination with other points but lacks the requisite authority.  Atlas thus is requesting the above-described exemption.  

Grant of the exemption is in the public interest because it will afford Atlas greater flexibility, the ability to meet shipper demand and increased U.S.-Brazil revenue.  There are no adverse considerations from the international aviation policy perspective.  Notably, while U.S. carrier authority to Curatiba and Fortaleza will be extra bilateral, Atlas representatives have had discussions with Brazilian civil aviation authorities and are optimistic that Brazil will permit Atlas to serve those two points.  

Atlas hopes to be able to start service to Curatiba and Fortaleza sometime in September.  Accordingly, expeditious action is required.  Atlas intends to poll the carriers served with this application and will inform the Department of the results.

OST-01-10400 August 27, 2001 Re:  Polling Letter Exemption - U.S.- Brazil All-Cargo

On August 14, 2001, Atlas Air, Inc. applied for an exemption to serve Curatiba and Fortelaza, Brazil. As we indicated we would do, we have polled all airlines served with the referenced application. Representatives of each of those airlines (American, Continental, Delta, FedEx, Polar, United and UPS) have authorized us to state that their airlines do not object to the Atlas request for authority.

Given the absence of objections to the referenced application and Atlas' need for the authority, we urge the Department to grant the application expeditiously.

Requests renewal of its exemption authorizing it to engage in scheduled foreign air transportation of property and mail between the United States, on the one hand, and Curitiba and Fortaleza, Brazil, on the other, via intermediate points and beyond Brazil, and to integrate that authority with its other certificate and exemption authorities. Atlas requests that this exemption be renewed for a two-year period.
