Renewal of ATA's Los Angeles-Cancun exemption authority is consistent with the public interest. ATA's nonstop service provides passengers with a needed competitive alternative to service provided by Alaska Airlines and by Mexicana Airlines through its codeshare with United Airlines. At the same time, continuing ATA's service will guarantee that valuable bilateral rights are utilized fully by United States carriers.

The Los Angeles-Cancun route is covered by the U.S.-Mexico Air Transport Agreement, as amended, which authorizes designated U.S. carvers to operate from a point or points in the United States to a point or points in Mexico. ATA understands that sufficient designations remain available for U.S. carriers to permit ATA to continue scheduled service between Los Angeles and Cancun.

Application for Renewal of Exemption Authority

Respectfully requests a two-year renewal of the exemption authority granted by Notice of Action Taken dated November 27, 2001, to engage in the scheduled foreign air transportation of persons, property, and mail between the terminal point Los Angeles, California and the terminal point Cancun, Mexico. The exemption authority currently is set to expire on November 27, 2003. By this renewal application, ATA asks the Department to renew its Los Angeles-Cancun exemption authority for a minimum of two (2) years.

ATA's nonstop service provides passengers with a needed competitive alternative to service provided by Alaska Airlines and by Mexicana Airlines through its codeshare with United Airlines.

Re: Termination of Service

In accordance with the requirements of Order 1988-10-2 and the conditions attached to the exemptions granted in the above-captioned dockets, ATA Airlines, Inc. hereby notifies the Department of Transportation that ATA has terminated service on each of the following routes and does not intend to resume service:

Chicago (Midway)-Ixtapa/Zihuatanejo Docket OST-2003-14527
Chicago (Midway)-Cozumel Docket OST-2004-17377

ATA has no objection to allocation of its designations to serve these routes to other U.S. carriers.
