OST-99-6408 October 25, 1999 Application for an Exemption U.S.-Portugal Charters

SATA Internacional seeks authority to provide non-scheduled air transportation of persons and cargo, separately or in combination, between a point or points in Portugal and a point or points in the United States and between a point or points in the United States and a point or points in Portugal (i.e. Third and Fourth Freedom flights). SATA Internacional intends to institute North Atlantic charter service in a conservative manner. beginning with a limited number of flights to the United States and Canada. It hopes to begin service to the United States in January, 2000. At the present time, SATA Internacional plans initially to provide charter flights for tour operators between Boston, in the United States. and, in Portugal, Lisbon and the Azores. SATA Internacional expects to begin service with a relatively modest pattern of flights:  

SATA Internacional anticipates some seasonal fluctuation in its service. The frequency of flights will increase in the Summer and at Christmas time and decline based on demand for charter flights during other parts of the year. For the first year of operations, SATA Internacional does not plan to operate more than 92 flights. While SATA Internacional will focus its attention on passenger charters, it is also requesting authority to operate cargo charters. SATA Internacional does not believe there is a large demand for cargo charter transportation in the Portugal-United States market, but there is some, and SATA Internacional wants to be able to respond to it when it arises. SATA Internacional intends to institute its transatlantic service with an AIRBUS A310-300, which the Company will lease from Credit Lyonnais a French Bank. Although it is not likely, it is possible that SATA Internacional may find it necessary to wet lease equipment from time to time on an ad hoc basis from United States or Portuguese carriers.

Files this amendment to clarify that while its authority from the Portugese Government refers to "non-scheduled" authority, SATA is seeking charter authority from the Department. Therefore, we request that SATA's exemption application filed in the above docket be amended by substituting the term "charter service" for "non-scheduled service" throughout.

Earlier this year, the Department acknowledged SATA's continuing fitness by issuing its Notice of Action Taken dated June 5, 2000 in Docket OST- 2000-7445, by which the Department approved the joint application of SATA Internacional and TAP Air Portugal ("TAP") for a Statement of Authorization permitting SATA to wet-lease a portion of an A-3 10 aircraft to TAP during the period June 12, 2000 through October 27, 2000 for service between Boston and Ponta Delgada, Portugal. The Department renewed the Statement of Authorization on October 4, 2000 for service through April 5, 2001.

WHEREFORE, SATA respectfully requests the Department issue an order granting renewal, for two years or until issuance of a Foreign Air Carrier Permit of SATA's exemption from 49 U.S.C. § 41301 and any other statute or Economic Regulation of the Department to the extent necessary, to permit it to continue to continue to engage in charter foreign air
transportation of persons, property and mail between points in the U.S. and Portugal and to perform other charters in accordance with Part 212 of the Department's regulations, and for such other, further, different, or additional relief as the Department finds in the public interest.

Pursuant to its exemption authority, SATA commenced U.S. - Portugal operations in January 2000, and since that time has provided safe and efficient charter air transportation between the U.S. and Portugal. The exemption was renewed by NOAT dated February 7, 2001.

Enclosed is updated financial information for SATA Internacional to support issuance of its foreign air carrier permit.  SATA has now been operating to the U.S. for almost three years.  During that time, it has developed a strong satisfied customer base and has remained competitive despite the economic travails facing the industry.

OST-99-6408 March 4, 2003 Re:  Correction to Net Income for 2002 Exemption - US-Portugal Charters

This is to advise that there was an error in our letter of February 19, 2003 regarding SATA's net income for the year 2002. The correct net income figure which was reported on the Statement of Operations attached to the February 19 letter should have been $281,556 (€259,870) (at exchange rate of E1 = $1.08345).
