Northwest asks the Department to amend its Experimental Certificate of Public Convenience and Necessity for Route 564 to incorporate the following additional U.S.-Mexico segments :

Northwest will offer service between the U.S.-Mexico city pairs listed in Segments E-H pursuant to its codeshare agreement with Alaska Airlines and will display its code on scheduled flights operated by Alaska on each of these routes. Similarly, Northwest will offer service between the U.S.-Mexico city pairs listed in Segments I-L pursuant to its codeshare agreement with Continental Airlines and will display its code on scheduled flights operated by Continental on each of the listed routes.

To the extent that Northwest is asking the Department to waive altogether its dormancy requirement with respect to these routes, Northwest's request is overly broad and should be denied. A general dormancy waiver that is not tied to specific routes or invoked during identifiable seasonal cessations would enable Northwest to retain otherwise dormant U.S.-Mexico route authority and potentially prevent other U.S. carriers from offering competing service on the routes. Until all designation limitations are removed from the U.S.-Mexico market, Northwest should be required to abide by the same dormancy requirements as all other U.S. carriers holding U.S.-Mexico authority. See, e.g., Order 99-6-6 at 7 ("The dormancy conditions were designed to maximize U.S. carrier opportunities under the U.S.-Mexico aviation agreement to ensure that limited-entry routes not being served would be readily available for service by other carriers.") United also questions the wisdom of incorporating U.S.-Mexico code-share routes into certificate authority.' It is hard to see how incorporation would "reduce the administrative burden" on the Department, as Northwest claims. The Department's dormancy requirements would continue to apply to each of these routes, many of which may prove to involve a high level of dormancy. Indeed, Northwest recently sought an extension of the start-up requirement for each and every U.S.-Mexico route on which it seeks to code share with Alaska and Continental - the same routes for which Northwest now seeks long-term certificate authority.' If Northwest's application were granted, its certificate would quickly become outdated and remain so for many years. Because certificates are infrequently updated, it would be difficult for other U.S. carriers to determine which of the segments were actually dormant and available for alternate U.S. carrier service.

Northwest asks the Department to amend its Route 564 U.S.-Mexico certificate authority by adding Newark-Acapulco, Newark-Puerto Vallarta and Newark-San Jose del Cabo segments. Northwest will offer service between Newark and Acapulco, Puerto Vallarta and San Jose del Cabo pursuant to its code-share arrangement with Continental Airlines, Inc. and will display its NW* code on Continental's seasonal flights operated over these routes. 3. Route 564 U.S.-Mexico certificate to include the Memphis-Mexico City, Memphis-Puerto Vallarta, and Detroit-Cozumel Segments

Northwest requests that the Department amend its Route 564 U.S.-Mexico certificate authority by adding Memphis-Mexico City, Memphis-Puerto Vallarta, and Detroit- Cozumel segments.  Further amendment of Northwest’s Route 564 certificate is in the public interest. Northwest’s U.S.-Mexico service fosters competition among U.S. and foreign carriers serving Mexico and provides travelers and shippers in the U.S.-Mexico market with a variety of service options. In addition, amending Northwest’s Route 564 certificate to include Memphis-Mexico City, Memphis-Puerto Vallarta, and Detroit-Cozumel segments will reduce the administrative burden on the Department by eliminating the need for frequent exemption renewal applications.

Northwest will offer service between Los Angeles and Guadalajara pursuant to its codeshare arrangement with Alaska Airlines, Inc. and will display its NW* code on Alaska's flights over this route.

Northwest seeks renewal of its existing Route 564 Experimental Certificate of Public Convenience and Necessity for Route 564 last issued by Order 2001-4-15 which authorizes Northwest to serve named U.S.-Mexico routes.

Northwest further asks the Department, in renewing Northwest's existing Route 564 certificate, to amend such certificate to include U.S‑Mexico routes Northwest presently is authorized to serve by exemption as follows:

Since authority to serve the following segments has expired due to dormancy, renewal of these segments of Northwest’s existing Route 564 certificate is not requested: Detroit-Ixtapa/Zihuatanejo, Phoenix-Puerto Vallarta/San Jose del Cabo, San Diego-San Jose del Cabo and San Francisco-Mazatlan.

Since authority to serve the following segments has expired due to dormancy, incorporation of the authority on these segments into Northwest’s Route 564 certificate is not herein requested: Seattle-San Jose del Cabo/Puerto Vallarta/Mazatlan and San Francisco-Ixtapa/Zihuatanejo.

Application for an Amendment of Certificate Authority

Northwest requests that the Department amend its Route 564 U.S.-Mexico certificate authority by adding the city pair markets identified above. Northwest’s current certificate for U.S.-Mexico service was last issued on February 26, 2001. See Order 2001-4-15. Northwest filed an application to renew its certificate authority in this docket on November 30, 2004.

Northwest seeks to offer scheduled foreign air transportation of persons, property and mail in the above-identified city pair markets pursuant to its codeshare arrangements with Delta and Continental. Specifically, Northwest intends to place its NW* code (1) on flights operated by Continental between Houston, Texas and Queretaro, Mexico, and (2) on flights operated by Delta between Cincinnati, Ohio and Cabo San Lucas, Mexico, and between Atlanta, Georgia, on the one hand, and Cozumel, Merida, and Puerto Vallarta, Mexico, on the other hand. Northwest also requests that the Department integrate this authority with all of its existing certificate and exemption authority. Delta and Continental/Continental Express hold underlying authority to serve the markets described in this application.

Northwest is simultaneously applying in a separate docket for an exemption and a designation to provide the services covered in this application. Northwest requests that the Department grant its corresponding exemption and process this certificate application in accordance with the new streamlined procedures outlined in Department’s Notice served August 26, 2005, Docket OST-2005-22228.

Re: Additional Codesharing

Northwest Airlines, Inc. requests that the Department notify Mexico of the addition of ExpressJet Airlines, Inc. as an additional operator for Northwest-marketed services on the Houston-Mexico City and Houston-Veracruz routes, where Northwest already holds underlying economic and codeshare authority. Pursuant to Order 2008-3-12, marketing carriers such as Northwest "may change, add, or subtract a U.S. direct-carrier partner without the need to amend its underlying economic authority to serve the U.S.-Mexico city-pair market." Northwest has conducted an advance poll of the U.S.-Mexico carriers on the attached service list, and determined that there are no objections to this request. Accordingly, we request that the notification be issued immediately.
