Air Excursions was organized by Mr. Steven Wilson as a sole proprietorship under the laws of the State of Alaska and began operations as an air taxi in January 1991. In November 1999, Mr. Wilson changed the organizational structure of the company to a limited liability company, and in February 2000, all of the stock in the company was transferred to Mr. Michael Loverink. Air Excursions currently operates on-demand service between Gustavus and Juneau. If its application is approved, the carrier plans to convert these on-demand passenger flights to scheduled service and to carry mail. Air Excursions will provide the proposed service using a five-passenger PA-32 aircraft which is owned by Mr. Wilson.

If granted the certificate authority it seeks, Air Excursions intends to provide limited scheduled passenger service between Gustavus and Juneau, Alaska. In addition, the carrier intends to carry mail. The company expects that its proposed scheduled operations will total approximately 312 additional flight hours per year.

This letter is to remind Air Excursions that on March 14, 2002, one year will have elapsed since the company's fitness determination, and that, unless we receive the documents necessary to make Air Excursions' certificate authority effective prior to that date, we intend to revoke Air Excursions' certificate authority without further notice to the carrier.

Air Ex requests this exemption due to pending changes in the law that governs dispatch and carriage of mail with the State of Alaska. Separate but essentially identical bills have been filed in the House and Senate of Congress that would fundamentally change the way U.S. Mail is dispatched to air carriers within the State of Alaska, the way compensation is computed, and the rights of carriers to match the rates of competing carriers. The original version of the proposed law, HR 3444, was introduced in the summer of 2001. This was subsequent to the certification of Air Ex, but well prior to the end of the activation period of the certificate.

Until the outcome of the proposed legislation is clear, it is premature to activate Air Ex's certificate authority. In order to activate its authority, Air Ex would have to purchase additional passenger liability insurance at a cost exceeding $50,000. As noted above, there has been no change in key personnel or compliance record. Financials for the period ended April 30, 2002 are attached. Clearly Air Ex remains financially fit. It has nearly $75,000 in working capital, and was profitable during the deep winter season. The exemption sought herein will not adversely affect any party or create a burden on anyone other than Air Ex. Indeed, if Air Ex is required to re-apply for its certificate authority, Department staff would be required to duplicate effort already spent in the current proceeding. The requested exemption will not give Air Ex any unfair or undue advantage.

Certificate of Public Convenience and Necessity

Order 2003-1-10, the Department revokes the interstate scheduled passenger certificate issued to Air Excursions, LLC (Air Excursions) for reason of dormancy.

It has now been almost 22 months since Air Excursions was found fit to provide interstate scheduled service and it has yet to file the documents necessary to make its certificate effective or to file information on the effect that the changes in the law with respect to the carriage of mail may have had on Air Excursions' proposed operations. Under these circumstances, we will revoke, without prejudice, Air Excursions' certificate for reason of dormancy.
