American requests a statement of authorization to display the "SR" designator code, in conjunction with foreign air transportation of persons, property, and mail on routings involving the United States and Switzerland, on flights operated by American between (l) any points in the United States; (2) any points in the United States and any points in Switzerland (either nonstop or over any intermediate points in any country); (3) any points in the United States and any points in any third country; and (4) any points in Switzerland and any points in any third country. Swissair requests a statement of authorization to display the "AA" designator code, in conjunction with foreign air transportation of persons, property, and mail on routings involving the United States and Switzerland, on flights operated  by Swissair between (l) any points in Switzerland; (2) any points in the United States and any points in Switzerland (either nonstop or over any intermediate points in any country); (3) any points in Switzerland and any points in any third country; and (4) any points in the United States and any points in any third country.

I am writing concerning Swissair's Notice of Additional Codesharing with American which was submitted herein on March 1, 2000. In particular, I wish to clarify that, with respect to the Geneva-Paris (CDG) city-pair, the parties do not contemplate codesharing on US-France traffic via Geneva. Rather, American will operate its own aircraft between the US and Paris as it is authorized to do under its DOT authority and connect there to a Swissair aircraft between Paris and Geneva which will carry the I1AAII code in addition to the "SRI' code. In other words, third country codesharing between the US and France is not involved.

While, looking at this from the US side of the Atlantic, we can understand that the notice -- by saying Geneva-Paris instead of Paris-Geneva -- could be perceived as indicating that the codeshare would serve Paris via Geneva; but that is not the case.

United previously has filed a pending application for authority to operate third-country codeshare service to Georgia in conjunction with Austrian Airlines ("Austrian") via Austria, an open skies country, pursuant to a blanket statement of authorization previously issued by the Department (Docket OST-00-7750). That application is non-controversial and has not been opposed by any party. On September 12, 2000, United submitted an answer to American's application in which United argued that it would be unfair for the Department to authorize American to commence third-country codeshare service to Tbilisi before approving United's application for similar, competitive service. (United hereby is attaching a copy of that answer for inclusion in the above docket.) 

United objects to American's application (and Swissair's related plans to place American's code on its Zurich-Tbilisi services) unless United's contemporaneous application is approved no later than American's. United's concerns are twofold. First, United is concerned that if the Department were to approve American's application before United's, American could implement third-country codeshare service to Georgia before United.

American Airlines, Inc. hereby applies to amend its statements of authorization under 14 CFR Part 212 to engage in codesharing services with the foreign air carriers listed in the above caption' so as explicitly to include affiliates TWA Airlines LLC, American Eagle Airlines, Inc., and Executive Airlines, Inc. d/b/a American Eagle. This amendment would allow each affiliate to display the respective foreign carrier designator code on authorized domestic and transborder code-share routes' where service is operated by the affiliate. Effective December 2, 2001, TWA Airlines LLC will hold itself out to the traveling public as American Airlines. As of that date, the two-letter "TW" designator code will no longer be displayed, and all flights operated by TWA will be shown as "AA*" in computer reservations systems. American Eagle and Executive have long operated exclusively as "AA*."
