American requests a statement of authorization to display the "SN" designator code, in conjunction with foreign air transportation of persons, property, and mail on routings involving the United States and Belgium, on flights operated by American between (l) any points in the United States; (2) any points in the United States and any points in Belgium (either nonstop or over any intermediate points in any country); (3) any points in the United States and any points in any third country; and (4) any points in Belgium and any points in any third country. Sabena requests a statement of authorization to display the "AA" designator code, in conjunction with foreign air transportation of persons, property, and mail on routings involving the United States and Belgium, on flights operated by Sabena (or by Sobelair or DAT under wet lease to Sabena 2 ) between (l) any points in Belgium; (2) any points in the United States and any points in Belgium (either nonstop or over any intermediate points in any country); (3) any points in Belgium and any points in any third country; and (4) any points in the United States and any points in any third country.

It would be unfair to United and Lufthansa and contrary to U.S. competition policy to grant American and SABENA the blanket statements of authorization which they seek while the Belgian government precludes United and Lufthansa from fully implementing their codeshare services via Brussels. American and SABENA propose to serve eight points in Germany via Brussels under their code share. This code share would allow SABENA to offer services on American's flights between these eight points in Germany and Chicago as well as the numerous U.S. points American serves beyond its Chicago hub. American will gain access between these eight points in Germany and its U.S. network by code sharing on SABENA's services between those German points and Brussels. United and Lufthansa would like to offer competition in many of these same U.S. -Germany city pairs via Brussels. In particular, the connections at Brussels would offer additional competitive options to passengers served between cities on Lufthansa's German network and United's Washington Dulles hub as well as cities served by United beyond that hub.

United opposes the grant of codeshare authorizations to Sabena and American for services between the U. S. and points in Germany via Belgium. It does not oppose the grant of any other codesharing authorizations Sabena and American are seeking in this Docket, and no other comment in opposition has been filed. United complains that the Government of Belgium will not allow Lufthansa to display its code on flights that United operates between Belgium and the U.S. United contends that the Government of Belgium is obligated by the terms of the U. S. - Belgium and U. S. Germany bilateral air services agreements to grant Lufthansa and United the necessary authorizations. United is mistaken. It confuses operating authority with codesharing authority. It ignores the air services agreement between Belgium and Germany, which does not provide traffic rights to German carriers to operate between Belgium and the U.S.

It is important to note that United is not urging the U.S. to restrict SABENA/American. Rather, United is simply urging the U.S. to take the actions necessary to enforce United's full code-share rights under the U.S./Belgium agreement. Once Belgium allows Lufthansa to hold out service on United's Brussels-Washington flights, even on a blind sector basis, United will have no objection to approval of the SABENA/American application in full. Any failure by the U.S., however, to enforce United's rights under the U. S./Belgium agreement will give SABENA and its U.S. alliance partners an unfair advantage over United and its alliance partner Lufthansa, the very result that Article 8, Section 7(b) of the U. S./Belgium agreement was designed to prevent.

The Department should approve those portions of the SABENA/American statements of authorization which the carriers need to implement in the first phase of their code-share services in October. This involves mutual code shares on each other's transatlantic services between the U.S. and Belgium. At the same time, the U.S. should consult with the government of Belgium in an effort to persuade it to reconsider its position with respect to Lufthansa's code share on United's Brussels-Washington flights. Until such time as the government of Belgium is prepared to authorize those blind-sector code-share services consistent with Article 8, Section 7 of the U.S./Belgium agreement, the Department should withhold approval of SABENA's statement of authorization to display American's code on SABENA's Brussels-Germany services.

Sabena and American call upon the Department promptly to perform its duty under the U.S.-Belgium Open Skies agreement and grant all of the codesharing authorizations they have requested in this Docket. The latest Response (United's third) contains no facts and no arguments that the Joint Applicants have not previously refuted and shown to be meritless. In the circumstances, this Response is merely repetitious, vexatious, and intended to promote delay. The concerns United and Lufthansa express are matters for the Governments of Belgium and Germany, not the Department.

On November 2, 1999, we approved in part the code-share application of American Airlines, Inc. and its affiliated regional airlines and Sabena Belgian World Airlines and its regional affiliated airlines in Docket OST-99-5943 and deferred on the portion of the application relating to code-share operations involving one of Sabena's regional affiliates, Delta Air Transport (DAT), pending advice from the Federal Aviation Administration on fitness issues relating to that carrier. The Federal Aviation Administration has now notified the Department that it interposes no objection to approval of this portion of the application. We are, therefore, approving the remainder of the application.

American Airlines, Inc. hereby applies to amend its statements of authorization under 14 CFR Part 212 to engage in codesharing services with the foreign air carriers listed in the above caption' so as explicitly to include affiliates TWA Airlines LLC, American Eagle Airlines, Inc., and Executive Airlines, Inc. d/b/a American Eagle. This amendment would allow each affiliate to display the respective foreign carrier designator code on authorized domestic and transborder code-share routes' where service is operated by the affiliate. Effective December 2, 2001, TWA Airlines LLC will hold itself out to the traveling public as American Airlines. As of that date, the two-letter "TW" designator code will no longer be displayed, and all flights operated by TWA will be shown as "AA*" in computer reservations systems. American Eagle and Executive have long operated exclusively as "AA*."
