AttachmentLegend's Answer in Love Field Docket Filed November 18th

Legend Airlines, Inc., respectfully files the following Opposition to the City of Forth Worth, Texas Motion to Stay Portions of Order No. 99-8-27 and Request for Expedited Consideration. In its Motion, Fort Worth requests the Department of Transportation to stay all actions, including Docket No. 16-99-17, to enforce a certain portion of DOT Order 99-8-27. There is no basis to stay any proceeding to enforce Order 99-8-27 before either the Department or the FAA pending a decision from the United States Court of Appeals for the Fifth Circuit in Case No. 99-60008. For the reasons set forth in Legend's attached filing in the Love Field Interpretation Proceeding (OST-98-4363), Legend respectfully requests that the Department dismiss Fort Worth's Motion in this docket.

    Service List

Fort Worth seeks to enforce a nebulous "status quo" at Love Field that would allow some carriers to operate under the Wright Amendment while others could not and would allow some carriers to operate under the Shelby Amendment while others could not. By seeking a stay, Fort Worth is, in essence, asking the Department to overturn federal law and unjustly -discriminate against Ozark and other carriers. It is imperative that the Department and the FAA interpret and enforce aviation law. The Department cannot cede control over interstate commerce to a city; to do otherwise would be to neglect its duty to the public.

Order 2005-03-05
OST-99-5288 - Certificate of Public Convenience and Necessity - Interstate Scheduled

Issued and Served March 3, 2005

Order Revoking Certificate Authority | Word

By this order, we revoke the interstate scheduled certificate issued to Ozark Airlines, Inc. d/b/a Great Plains Airlines by Order 2000-3-22 for reason of dormancy.

On January 6, 2005, we advised Ozark that more than nine months had elapsed since its authority had been suspended and we had heard nothing from the company regarding its intention to resume operations. At that time, we further reminded the carrier that its certificate would be revoked if the Department did not receive notification from Ozark of its intent to resume operations on or before February 21, 2005. That date has passed and we have heard nothing from the carrier.
