Delta and Sabena respectfully request that the Department renew, on an indefinite basis, the code-share authority described herein, to enable the carriers to continue to provide code-share services that are consistent with their underlying international authority and with applicable international agreements, and grant such other and further relief as the Department determines to be in the public interest.

Joint Answer of Northwest and KLM

Renewal of Blanket Codeshare Authority

Delta and Sabena now ask the Department to renew their blanket Statements of Authorization even though the Department has yet to grant Northwest and KLM's initial application. It would be grossly unfair to both Northwest and KLM, and seemingly indefensible as a matter of policy and procedure, for the Department to renew the Statement of Authorizations of Delta and Sabena before granting the application of Northwest and KLM. This situation is particularly inexplicable because the Northwest-KLM code-share alliance was implemented years before Delta's alliance with Sabena was implemented, and the underlying U.S.-Netherlands open skies agreement was signed years before the United States signed its open skies agreement with Belgium.

Consolidated Reply of Delta Air Lines to Joint Answer of Northwest and KLM

Renewal of Exemption and Codeshare Authority; Blanket Codeshare Authority

The Department's policy is to evaluate each application for code-share authority on a case-by-case basis, and there is no basis to link Delta's alliance renewal applications to the pending Northwest/KLM applications. The Department apparently has some reason(s) for not yet acting on the Northwest/KLM Application. Those reasons are not known to Delta and have no relevance to Delta's renewal requests. It is inappropriate for Northwest and KLM to attempt to delay the orderly processing of Delta's code-share renewals through the submission of an irrelevant responsive pleading, especially in light of Northwest/KLM's non-opposition to the applications. Northwest and KLM are free to communicate their concerns directly to the Department without interfering with Delta's applications.
