United objects to any action being taken on these other applications in advance of its joint application in Docket OST-97-3237. It would be both unfair and potentially prejudicial if the Department were to grant other outstanding requests before approving the United/Mexicana application, particularly where, as here, several of the applicants request authority for the same transborder city pairs. In addition, United and Mexicana would be competitively disadvantaged if the Department were to enable other competitors to introduce new services in U. S.-Mexico markets before the Department grants the pending United/Mexica.na applications, enabling United and Mexicana to do so.

Northwest Airlines

Scheduled foreign air transportation of persons, property, and mail between (1) the terminal point Detroit, Michigan, on the one hand, and the coterminal points Cancun, Mexico City, Puerto Vallarta, and Ixtapa/Zihuatanejo, Mexico, on the other hand; (2) the terminal point Memphis, Tennessee, and the terminal point Cancun, Mexico; (3) the terminal point Minneapolis/St. Paul, Minnesota, on the one hand, and the cotertninal points Acapulco. Cancun, Cozumel, Puerto Vallarta, San Jose del Cabo, and Ixtapa/ Zihuatanejo, Mexico, on the other hand; and (4) the terminal point Tampa, Florida, and the terminal point Cancun, Mexico. Continental proposes to serve the markets pursuant to a code-share arrangement with Northwest Airlines, Inc., whereby Continental will place its designator code on Northwest flights in the subject markets. Continental asks the Department to extend the dormancy condition for -commencement of Continental's U.S.-Mexico code-share services through December 1, 1999, and to shorten the answer period on this request to August 27, 1999. By Notice of Action Taken on June 4, 1999, the Department granted Continental an exemption to provide scheduled combination services on the following U.S.-Mexico routes, which Continental will serve under code-share arrangements with Northwest and Alaska, respectively:

Continental plans to begin code-sharing with Northwest and Alaska on the routes identified above as soon as the Government of Mexico approves Continental's pending applications to do so. Securing approval from Mexico for the Continental/Northwest and Continental/Alaska code-share arrangements is taking longer than anticipated and has forced Continental to defer the start-up of its U.S.-Mexico code-share operations.

OST-99-5154 November 2, 1999 Request for Extension of Dormancy U.S.- Mexico Codeshare with Alaska Airlines and Northwest Airlines

Continental asks the Department to extend the dormancy condition for commencement of Continental's U.S.-Mexico code-share services through February 29, 2000. By Notice of Action Taken on June 4, 1999, the Department granted Continental an exemption to provide scheduled combination services on certain U.S.-Mexico routes, which Continental will serve under code-share arrangements with Northwest and Alaska. That exemption authority included a dormancy condition requiring commencement of Continental/Northwest and Continental/Alaska U.S.-Mexico code-share services by September 2, 1999. The Department subsequently granted Continental's request to extend the start-up dormancy condition through December 1, due to unexpected delays in securing Mexican approval for the code-shares. (See Approval dated August 30, 1999). Continental plans to begin code-sharing with Northwest and Alaska on the routes identified above as soon as the Government of Mexico approves Continental's pending applications to do so. Securing approval from Mexico for the Continental/Northwest and Continental/Alaska code-share arrangements is continuing to take longer than anticipated and has forced Continental to defer further the start-up of its U.S.-Mexico code-share operations. Continental's deferral of its new U.S.-Mexico code-share services results from circumstances beyond Continental's control. Extending the dormancy condition for an additional 90 days, through February 29, 2000 is in the public interest because it will allow travelers and shippers to begin benefiting from the code-share services and new travel options as soon as Mexico approves Continental's applications.
