American Airlines, Inc., under 49 USC 40109, hereby applies for an exemption authorizing foreign air transportation of persons, property, and mail between points in the United States, via points in Fiji and New Zealand, and Sydney, Melbourne, Brisbane, Cairns, and Perth, Australia, and beyond to Adelaide and to points in New Zealand. American also requests the right: to integrate such authority with its existing U.S.-Australia/New Zealand/Fiji certificates and exemptions. The requested authority will be used for an expanded codesharing arrangement with Qantas Airways Limited, under which the ''AA'' designator code will be displayed on certain flights operated by Qantas between the U.S. and Australia, between points within Australia, and between Australia and New Zealand, in conjunction with American-Qantas codesharing flights serving the United States. Qantas is separately submitting an undocketed application for an amended statement of authorization under 14 CFR Part 212.

In response to an inquiry from the Department's staff, American Airlines, Inc. and Qantas Airways Limited hereby state that their codesharing arrangement is non-exclusive. Section 9.1 of their Code Share Agreement of September 15, 1995 provides that "[t]his Agreement is non-exclusive and does not preclude either party from entering into and maintaining marketing relationships, including code-sharing, with other airlines."   American and Qantas request immediate and favorable action on their unopposed applications, submitted on January 14, 1999, for authority to expand their codesharing arrangement (OST-99-5007 and undocketed).

Hereby applies for renewal of its exemption, initially granted by Notice of Action Taken in this docket on February 10, 1999, and renewed on February 27, 2001, authoriz­ing foreign air transportation of persons, property, and mail between points in the United States, via points in Fiji and New Zealand, and Sydney, Melbourne, Brisbane, Cairns, and Perth, Australia, and beyond to Adelaide and to points in New Zealand, with the right to integrate such authority with its existing U.S.-Australia/New Zealand/Fiji certificates and exemptions.  American also holds exemption authority in OST-1995-660 (most recently renewed on February 27, 2001) authorizing service between Los Angeles and Melbourne via Auckland. American will not seek renewal of that exemption, since such authority is subsumed in the authority granted in OST-1999-5007.

American uses this authority to engage in codesharing services with Qantas Airways Limited. Qantas separately holds a statement of authorization under 14 CFR Part 212 (No. 99-18), issued under assigned authority on February 10, 1999 (indefi­nite duration).

Application for Renewal of Exemption

American Airlines, Inc. hereby applies for renewal of its exemption, last renewed by Notice of Action Taken in this docket on December 10, 2004, authorizing scheduled foreign air transportation of per-sons, property, and mail between points in the United States, via points in Fiji and New Zealand, and Sydney, Melbourne, Brisbane, Cairns, and Perth, Australia, and beyond to Adelaide and to points in New Zealand.

In response to the Department's notice of August 23, 2005 on streamlining regulatory procedures (OST-2005-22228), American has requested corresponding certificate authority for its U.S.-Australia exemption authority. See application for amended certificate of public convenience and necessity, August 26, 2005 (OST-2000-8516). We urge expedited approval of that application to avoid the need for successive renewals in exemption dockets.
