On January 7, 1998, JTA and JAL submitted a joint request: for a statement of authorization to codeshare on a daily roundtriip service operated by JAL between Tokyo and Guam commencing February 1, 1999 for a minimum duration of one year. The instant application is submitted to establish JTA's fitness to provide codeshare-only service under section IV.D, and to secure underlying operating authority to the extent such authority may be necessary. Neither a family assistance plan nor submission of passenger manifest information is required here because JTA will be providing codeshare service as a marketing carrier only and will not otherwise be operating a "covered flight segment,' within the meaning of 14 C.F.R. Part 243.

In connection with the above, we enclose a copy of a letter from the Japanese Ministry of Transport concerning the designation of JTA pursuant to section IV.D. of the Memorandum of Understanding between the United States and Japan which entered into force on April 20, 1998 pursuant to an exchange of notes. Also enclosed is a copy of the relevant operating authority issued to JTA by the Japanese Ministry of Transport.

Japan TransOcean states that its service under the exemption would be provided on a code-share only basis on flights operated by Japan Airlines.

The agreement in Docket OST-98-4892 is comprised of resolutions affecting foreign air transportation between U.S. points in Area 3 (Guam, Saipan and Pago Pago) and points in South East Asia, South West Pacific, and the South Asian Subcontinent. The agreement amends children's fare percentages by area and market; sets first class and economy fares from Bangkok to Guam and Saipan and first class and business class fares from Bangkok to Pago Pago at government approved levels; makes minor changes to excursion fare seasonality and other conditions of travel; and despecifies fares between Pusan and Guam and Saipan to reflect cessation of direct service.
