TAROM - Romanian Air Transport

The cargo transported by TAROM from Charlotte, North Carolina to Puerto Rico will consist unfinished materials and occasional relief goods, southbound (50 - 60,000 lbs.) and finished product northbound (60 - 70,000 lbs.).  Upon request of Leading Edge Air Logistics of Tennessee, and if approved by the Department, TAROM will operate the flights on a temporary basis as a stand-in for a U.S. carrier. The charterer has provided this service regularly using U.S. carriers. However, due to the hurricane, there is an increased demand for air cargo lift to and from Puerto Rico. The charterer has sought lift from every U.S. cargo carrier known to the charterer for this cargo which must be urgently transported and no U.S. cargo carrier can provide lift at this time. See attached letter.

The capacity shortfall experienced during every holiday season can hardly be called "an unusual circumstance not arising in the normal course of business." Were the Department to find that the test has been met in the case of the instant application, therefore, it would be hard pressed to deny any cabotage application by a foreign carrier where a shipper alleges temporary difficulty in finding available capacity on U.S. air carriers.

In short, TAROM has not satisfied the stringent requirements necessary for approval of an application to conduct cabotage services. Accordingly, Fine Air opposes TAROM's emergency application.
