Northwest seeks authority so it can provide scheduled foreign air transportation of persons, property and mail on all Continental flights between Newark, on the one hand, and Rio de Janeiro and Sac Paulo, Brazil; Bogota, Colombia; Quito and Guayaquil, Ecuador; Lima, Peru; and Caracas, Venezuela, on the other hand; and between Houston, on the one hand, and Bogota, Colombia; Quito and Guayaquil, Ecuador; Lima, Peru; and Caracas, Venezuela, on the other hand. Northwest intends to commence the proposed code-sharing with Continental as soon as possible by offering service between the U.S. and Brazil and Peru and asks that the Department grant Northwest exemption authority on an expedited basis to enable Northwest to seek foreign authority and engage in advance sales and marketing activities. Service at additional South American points will follow

American does not object to Northwest's application for U.S.-South America exemption authority needed to engage in codesharing services with Continental, provided that American's pending codesharing applications with Avianca (Colombia), Lan Chile (Chile), and Aeropostal (Venezuela) are granted as well.

United, therefore, urges that the Department defer action on Northwest's exemption application to the extent it seeks authority to code share on Continental's services to Bogota, Colombia. At such time as the Department is able to designate additional U.S. carriers to serve Colombia, it should address the issues raised by Northwest's instant application at the same time as it addresses those raised by other pending applications that have been deferred such as that of United

American Airlines, Inc. hereby moves for leave to file the following response to the answer submitted on December 16, 1998 by United Air Lines, Inc. in the captioned proceeding. American's response should be accepted in the interest of a complete record for the Department's consideration. In its answer, United asserts that "[a]lthough Avianca has agreed to code share with American...the Department has refused to approve their joint application for the necessary authority (Dockets OST-97-2081/83)" (p. 2). The Department has not "refused," but has deferred action pending advice from the Department of Justice. DOJ has notified the Department the: it has no objection to the proposed American/Avianca codeshare arrangement, and we anticipate approval.

Northwest is not seeking to pre-empt any United services to Colombia, and granting code-share authority to Northwest should not have any impact on United's ambitions to serve Colombia. Since the Northwest code-share with Continental does not involve any new flight operations serving Colombia, Northwest's code-sharing does not raise the same issues as United's effort to secure the right to operate its own services between the U.S. and Colombia. Once Northwest is granted underlying authority to code-share with Continental on U.S.Colombia services, Northwest can then seek codeshare authority in Colombia and consider with the Department the terms on which Colombia is willing to permit extra-bilateral code-sharing before any such services are instituted.

Amends its December 15, 2000 application for renewal of its exemption from 49 U.S. C. § 41101 authorizing Northwest to provide scheduled foreign air transportation of persons, property and mail between Newark and Houston, on the one hand, and points in Brazil, Ecuador and Peru, on the other hand, to include renewal of Northwest's exemption to provide service between Newark and Houston, on the one hand, and Bogotá, Colombia, on the other, pursuant to codesharing with Continental Airlines, Inc. Northwest also seeks authority to integrate its Newark/Houston-Bogotá exemption authority with Northwest's other exemption and certificate authorities and requests that its Newark/Houston--Bogotá authority be renewed for a period of no less than two years. Northwest further requests that the Department waive the advance filing requirement in Section 377.10(c)(1) of its Special Regulations and continue the effectiveness of Northwest's Newark/Houston-Bogotá exemption pending Departmental action on Northwest's amended renewal application.

On December 15, 2000, Northwest applied in this docket for renewal of its exemption to engage in scheduled foreign air transportation of persons, property and mail between Newark, on the one hand, and Rio de Janeiro and Sdo Paulo, Brazil; Quito and Guayaquil, Ecuador; and Lima, Peru, on the other hand; and between Houston, on the one hand, and Quito and Guayaquil, Ecuador; and Lima, Peru, on the other hand. Northwest now seeks to amend its December 15, 2000 renewal application to include a request for renewal of Northwest's Newark/Houston-Bogotá exemption authority, which was granted in this docket by a Notice of Action Taken dated May 19, 2000, and expires on February 17, 2001. Northwest plans to serve Bogotá by codesharing on flights operated by Continental.

Northwest seeks renewal of an exemption to engage in scheduled foreign air transportation of persons, property and mail between Newark, on the one hand, and Rio de Janeiro and Sao Paulo, Brazil; Bogota, Colombia; Quito and Guayaquil, Ecuador, and Lima, Peru, on the other hand; and between Houston, on the one hand, and Bogota, Colombia; Quito and Guayaquil, Ecuador; and Lima, Peru, on the other hand. In renewing Northwest's aforementioned exemption, Northwest requests that the Department amend the exemption to include Houston-Sao Paulo/Rio de Janeiro, Brazil, which Northwest currently is authorized to serve pursuant to route integration authority. Northwest intends to serve these markets by codesharing on flights operated by Continental Airlines, Inc.

Application for Renewal of Exemptions

Northwest hereby requests renewal of the exemption authorities, which enable Northwest to offer scheduled foreign air transportation of persons, property and mail between the United Sates and various foreign points. The exemption services are operated either by Northwest, or its codeshare partners Delta, Continental or ExpressJet. Northwest requests renewal of these exemptions for a period of at least two years.
