Renew exemption from 49 U.S.C. § 41301 to engage in charter foreign air transportation of property and mail between the Russian Federation and the United States; and other all-cargo charters subject to Part 212 of our rules. The Annexes to the U.S.-Russia Air Transport Agreement expired on January 22, 2001. However, the operations proposed by Polet are in conformance with the Annexes agreed to by both sides ad referendum on April 11, 2002. Both sides, as agreed, have initiated the necessary internal procedures for bringing these Annexes into force.

Polet Airlines hereby applies, pursuant to 49 U.S.C. § 40109(c) and, U.S.C. 558(c) as implemented by 14 CFR § 377.10(c)(3), for renewal of its exemption from the provisions of 49 USC. § 41301 to engage in charter foreign air transportation of property and mail between points in the Russian Federation and points in the United States, and to perform other charters subject to Part 212 of the Department's rules. That exemption was most recently renewed for the stated period of one year, by Notice of Action Taken in this Docket, issued on March 28, 2006 and expiring March 28, 2007.
Unless Polet's application for permit in Docket OST-1998-4582, as supplemented and further supplemented, is earlier issued, Polet requests that this application be granted for a period extending until the date of final disposition of Polet's long pending application for a foreign air carrier permit.
Applicant was identified in the application originally filed in this docket as Polyot Airlines. By fetter dated July 22, 2002, the Director of the Office of International Aviation of this Department acknowledged Applicant's request to register the trade name "Polet Airlines," for use independently of, or in conjunction with, "Polyot Airlines."

Order Granting Exemption and to Show Cause
By foreign air carrier permit application filed October 14, 1998, and supplemented March 2, 2006; March 14, 2006; and March 5, 2007, and exemption application filed March 5, 2007, Polet Airlines, a foreign air carrier of the Russian Federation, requests renewal of its existing exemption authority under 49 USC 40109 and a foreign air carrier permit under 49 USC 41301 to engage in charter foreign air transportation of property and mail between any point or points in the Russian Federation, on the one hand, and any point or points in the United States, on the other hand; and other charters in accordance with 14 CFR Part 212.
No answers were filed to either application.
By this order we (1) grant the application of the referenced foreign air carrier for an exemption renewal under 49 U.S.C. 40109, subject to conditions; and (2) tentatively find that it is in the public interest to grant the applicant the foreign air carrier permit.
