Polyot Airlines is a private company founded in 1989 by Mr. Anatoly S. Karpov and Mr. Igor M. Boev. From 1989 to 1992, Polyot performed numerous cargo and passenger flights, using both leased and its own aircraft (AN-1 2, AN24, AN-26, Yak-40, Yak-42) for performing flights in Russia, and between Russia and Africa, the Middle East, and Western and Eastern Europe. In late 1994, the company was reoriented to outsized cargo transportation, thus disposing of the above-mentioned aircraft. Since 1994 Polyot has specialized in outsized cargo and equipment transportation, using two aircraft AN-1 24-100, owned by Polyot Airlines.

Supplement to Application for Foreign Air Carrier Permit - Bookmarked

Polet proposes to operate an on demand cargo charter operation between points in the Russian Federation and points in the United States and, subject to prior U.S. DOT approval, between third counties and the United States and, as authorized by the Department, between points within the United States.

Polet has held exemption authority to operate between the United States and Russia since March 30, 2000, and has operated over 90 one-way cargo charter flights in its AN124-100 aircraft since April 2001 in Third and Fourth Freedom and, with prior Department approval, in Fifth Freedom and cabotage operations.

Polet requests issuance of the permit sought herein pursuant to the procedures set out in the August 26, 2005 Notice in Docket OST 2005-22228, and applied by the Department in Order No. 2005-8-17, Executive Airlines S.L.

Polet's application for renewal of its exemption, which expires by its terms on March 7, 2006, is filed simultaneously herewith.

Further Supplement

On March 2, 2006 Polet Airlines submitted a Supplement to its application for foreign air carrier permit in this docket. Attachment "B" thereto included as page 2, a part of the applicant's Russian Air Operator Certificate No. 14, showing an expiration date of March 11, 2006.

There is submitted herewith for inclusion in the docket as a further supplement to the application, a revised Page 2 of Attachment "B" showing that the validity of the Air Operator Ceitificate has been extended until March 9, 2008.

Further Supplement to Application for Foreign Air Carrier Permit

Polet Airlines, a Russian charter air carrier, filed its original application for Foreign Air Carrier Permit in this docket on October 14, 1998. Almost 8 years later, on March 2, 2006, in the absence of a permit grant by the Department Polet filed, simultaneously (1) a supplement to its application in the this proceeding and (2) an eighth application for renewal of its annual exemption, relying for the expedited disposition of its permit application on the Department's promise in Docket OST-2005-22228 for expedited issuance of the permit applied.

Polet now requests immediate issuance of its long sought permit in accordance with the stated policy of OST-2005-22228 and with the long standing provisions of the bilateral agreements between the United States and the Russian Federation. There has been no material change in Polet's financial or operating situation since March 2, 2006. Polet's most recently issued exemption in Docket OST-1998-4583 is now scheduled to expire March 28, 2007.

Out of an abundance of caution, Polet is simultaneously filing in that docket an alternative application for renewal of its exemption in the hope, nevertheless, that issuance of the requested permit will finally moot the necessity for grant of an exemption.

Order Granting Exemption and to Show Cause

By foreign air carrier permit application filed October 14, 1998, and supplemented March 2, 2006; March 14, 2006; and March 5, 2007, and exemption application filed March 5, 2007, Polet Airlines, a foreign air carrier of the Russian Federation, requests renewal of its existing exemption authority under 49 USC 40109 and a foreign air carrier permit under 49 USC 41301 to engage in charter foreign air transportation of property and mail between any point or points in the Russian Federation, on the one hand, and any point or points in the United States, on the other hand; and other charters in accordance with 14 CFR Part 212.

No answers were filed to either application.

By this order we (1) grant the application of the referenced foreign air carrier for an exemption renewal under 49 U.S.C. 40109, subject to conditions; and (2) tentatively find that it is in the public interest to grant the applicant the foreign air carrier permit.

We make final our findings and conclusions as stated in Order 2007-4-16 and award to Polet Airlines the foreign air carrier permit subject to the conditions attached to the Order (and attached to the present Order as Appendix A), and to the conditions that, in the conduct of the scheduled and charter services authorized herein, Polet Airlines must adhere to (1) FAA-approved flight routings; and (2) the Air Transport Agreement between the United States and the Russian Federation, including its Annexes.  In accordance with sections 212.9(d) and (e) of the Department’s rules, Polet Airlines shall not perform any charter(s) unless specific authority in the form of a statement of authorization for such charter(s) has been granted by the Department.
