Air Exel was formed in April 1991 and instituted service the following month by assuming from KLM Royal Dutch Airlines responsibility for operations on the Maastricht-Amsterdam route. Air Exel's business has expanded significantly since 1991, and today Air Exel serves numerous points in the Netherlands as well as major cities in other European countries. Under the carriers' codeshare agreement, Air Exel currently operates with its own aircraft and crews the Paris-Eindhoven segments of certain U.S.-originating and U.S.-destined Northwest scheduled flights. Northwest flights operating over U.S.-Paris-Eindhoven routes carry Northwest's code. Northwest operates the U.S.-Paris segment and Air Exel operates the Paris-Eindhoven segment. Air Exel does not sell seats in its name for travel to or from the United States and does not operate its aircraft to any U.S. point. Similarly, Northwest does not sell seats in its name on these flights for travel in the local Paris-Eindhoven market. Local Paris-Eindhoven flights operated by Air Exel under the codeshare agreement carry Air Exel's two-letter designator code in addition to Northwest's code. All codeshare flights are and will continue to be marketed in accordance with the Department's regulations on codesharing contained in 14 C.F.R. 257.

Application for Amendment of Statement of Authorization and Renewal and Amendment of Exemptions

Hereby requests renewal of the exemption Luthonties granted to it by the Department of Transportation in the above-captioned dockets authorizing Air Exel to perform scheduled foreign air transportation of persons, property and mail between (i) Amsterdam, Netherlands, and Antwerp, Belgium; (ii) Paris, France, and Eindhoven, Netherlands; and (iii) Amsterdam, Netherlands, and domestic Netherlands points, pursuant to a codeshare agreement with Northwest Airlines, Inc. Air Exel's current exemptions expire on July 13, 2003. Air Exel requests renewal of these exemptions for a two-year period on their existing terms and conditions.

Air Exel further requests amendment of its existing exemptions and statements of authorization to permit Air Exel to perform scheduled foreign air transportation of persons, property and mail between points in the Netherlands and points in third countries, pursuant to Air Exel's codeshare agreement with Northwest. Grant of this authority is consistent with the open skies agreement between the United States and the Netherlands, and will relieve Air Exel and the Department of the burden of preparing and reviewing multiple applications covering codesharing on various Netherlands-third country routes.

Air Exel Will No Longer Operate Services Previously Provided by KLM Cityhopper

Air Exel is no longer operating, and the services it provided previously are now being provided by KLM Cityhopper. Consequently, Air Exel withdraws the pending July 11, 2003, application for amendment and renewal of Air Exel's statement of authorization and exemption permitting it to codeshare with Northwest. Air Exel requests that the Department of Transportation dismiss this application.
