Air Tahiti NUI (Exemption and Foreign Air Carrier Permit)

Air Tahiti Nui seeks this exemption in order to commence four weekly scheduled combination services between Papeete, Tahiti, French Polynesia and Los Angeles on or about November 1, 1998, and desires to continue operating pursuant to this exemption until such time as the foreign air carrier permit is issued. Each flight will be operated with Airbus 340-200 aircraft with a configuration consisting of 36 business class and 250 economy seats.

Air Tahiti Nui requests this amended exemption authority in order to provide charter service between French Polynesia and the United States in accordance with market demand and, specifically, to transport passengers between Papeete, Tahiti, French Polynesia and Guam to attend the Pan Pacific athletic games on May 26, 1999 and June 15, 1999. All charter flights will be operated with Airbus 340-200 aircraft with a configuration consisting of 36 business class and 250 economy class seats.

The authority for Air Tahiti Nui to provide scheduled service initially was granted by the Department in Notice of Action Taken dated October 13, 1998 and was amended by Notice of Action Taken dated May 5, 1999 to include authority to conduct charter operations. Air Tahiti Nui's exemption authority currently is scheduled to expire on October 13, 2000. In filing this Application, Air Tahiti Nui hereby invokes the automatic extension provisions of the Administrative Procedure Act, 5 U.S.C. § 558(c), as implemented by Part 377 of the Department's Regulations, so that it may continue operations pending a final decision by the Department on this renewal request.

Air Tahiti Nui hereby applies for an amendment of its exemption from 49 U.S.C. § 41301 (formerly section 402 of the Federal Aviation Act, as amended) to the extent necessary to enable it to provide scheduled foreign air transportation of persons, property and mail between Papeete, Tahiti (French Polynesia), Los Angeles, California and Paris, France. Air Tahiti Nui recently has become aware of additional service opportunities in this market and wishes to begin marketing and selling the service as soon as possible. Service is expected to begin on or about September 13, 2001. Air Tahiti Nui will poll all carriers on the attached service list and advise the Department of the results.
Air Tahiti Nui plans to conduct the Paris operations using
A340-200 aircraft. Air Tahiti Nui proposes to conduct operations under the
