Amendment to Application for an Initial Foreign Air Carrier Permit

In its Application for an initial foreign air carrier permit submitted on August 13, 1998, Air Tahiti Nui requested authority to provide foreign air transportation of persons, property and mail between Papeete, Tahiti, French Polynesia and Los Angeles and to conduct charters in accordance with 14 C.F.R. Part 212. Pursuant to the Memorandum of Consultations dated October 19, 2001, amending the Air Transport Agreement between the Government of the United States of America and the Government of the French Republic, airlines of each Party shall, in accordance with the terms of their designation, be entitled to operate scheduled international air transportation, on inter alia, Route 4, which allows operation of service from points behind French Polynesia via French Polynesia and intermediate points to a point or points in the United States and beyond.' Air Tahiti Nui is designated by the French Republic to operate service on Route 4, and, accordingly, requests that its Application for an initial foreign air carrier permit be expanded to request the broad authority granted to it by the Memorandum of Consultations and the French Director General of Civil Aviation.

Issuing Foreign Air Carrier Permit

By application filed August 13, 1998, as amended, Air Tahiti Nui requests an initial foreign air carrier permit to engage in scheduled foreign air transportation of persons, property and mail from points behind French Polynesia via French Polynesia and intermediate points to the United States and beyond;' and authority to conduct charters in accordance with Part 212 of the Department's rules. In support of its application, Air Tahiti Nui states that it has been licensed and designated by the Government of France to perform the proposed services; that it is substantially owned and effectively controlled by citizens of France; and that it is operationally and financially fit to perform the proposed services.

The applicant recognizes that services via intermediate and beyond points is subject to further agreement between the United States and France. On January 22, 2002, the United States and France signed amendments to the June 16, 1998, Air Transport Agreement between the United States and France. The Agreement provides for various routes for the designated carriers of each side, and Air Tahiti Nui seeks authority consistent with the rights for which it has been designated by the Government of France.

Most recently, on January 3, 2003, we renewed, for a period of two years, Air Tahiti Nui's authority to engage in scheduled foreign air transportation of persons, property and mail between Papeete, Tahiti (French Polynesia), and Los Angeles, California; and between Papeete, Tahiti (French Polynesia) and Paris, France, via Los Angeles; and to conduct charters in accordance with Part 212.

Air Tahiti Nui has provided financial information which indicates that it can conduct the proposed services without jeopardizing passenger and shipper funds. Specifically, for calendar year ending December 31, 2002, Air Tahiti Nui reported total assets of $23 million; total liabilities of $16 million; and owners' equity of $7 million. For calendar year 2002, Air Tahiti Nui reported a profit of approximately $644 thousand. For calendar year ending December 31, 2001, Air Tahiti Nui reported total assets of $13 million; total liabilities of $9 million; ar d owners' equity of $4 million. For calendar year 2001, Air Tahiti Nui reported a loss of approximately $513 thousand
