Application for an Exemption

Royal Air Maroc and TWA have entered into an agreement to provide code share service for passengers traveling between the United States and Morocco and between Morocco and the Ivory Coast (subject to receipt of all required governmental approvals). Under the agreement flight operated by Royal Air Maroc between New York (JFK) and Casablanca (CMN) and between Casablanca (CMN) and Abidjan (ABJ), Marrakech (RAK) and Tangier (TNG) will display TWA's "TW" designator code as well as Royal Air Maroc's "AT" code and (b) flights operated by TWA between New York (JFK) and Boston (BOS), Chicago O'Hare (ORD), Los Angeles (LAX), Miami (MIA), Orlando (MCO), St. Louis (STL), San Francisco (SFO) and Washington National (DCA) will display Royal Air Maroc's "AT" designator code as well as TWA's "TW" code.

The Joint Applicants urge the Department to act as expeditiously as possible in approving this request, so that Royal Air Maroc's existing U.S. codeshare operations will not be unnecessarily disrupted, and so that Delta may begin offering beneficial new online services to Morocco. Specifically, the Joint Applicants request:

a) a statement of authorization to Royal Air Maroc, pursuant to 14 C.F.R. Part 212, authorizing Royal Air Maroc to display Delta's "DL" designator code on flights operated by Royal Air Maroc between (i) New York, New York, and Casablanca, Morocco, and (ii) Casablanca, Morocco, on the one hand, and Agadir, Marrakech and Tangier, Morocco, on the other hand;
b) a statement of authorization to Delta, pursuant to 14 C.F.R. Part 212, authorizing Delta to display Royal Air Maroc's "AT" designator code on flights operated by Delta between New York, on the one hand, and Atlanta, Boston, Chicago, Los Angeles, Miami, San Francisco, Tampa, and Washington, D.C., on the other hand;'
c) an exemption to Delta, pursuant to 49 U.S.C. § 40109, authorizing Delta to engage in scheduled foreign air transportation of persons, property, and mail between the United States and Tangier, Morocco, and to combine such exemption authority with Delta's existing certificate and exemption authority, to the extent permitted by international agreements; and
d) a new or amended exemption to Royal Air Maroc, pursuant to 49 U.S.C. § 40109, authorizing Royal Air Maroc to engage in scheduled foreign air transportation of persons, property, and mail between Morocco, on the one hand, and Atlanta, Boston, Chicago, Los Angeles, Miami, San Francisco, Tampa, and Washington, D.C., on the other hand, pursuant to a codeshare agreement with Delta.

OST-2002-12520 Continental Airlines, Inc., & KLM uk Limited, filed June 13, 2002. Exemption from 49 U.S.C. 41301 and statement of authorization pursuant to 14 CFR 212 of the Department's regulations to to display the airline designator code of Continental on flights operated by KLM uk between the Netherlands and third countries. On March 5, 2003, the applicants withdrew their application.

OST-98-4294 Royal Air Maroc, filed October 14, 1999. Application for Renewal of Exemption Authority

Royal Air Maroc hereby applies for renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property, and mail from points behind Morocco, via Morocco and international points, to points in the United States and beyond. The authority for which renewal is requested here was granted by Notice dated October 22, 2004, and Royal Air Maroc requests that this authority, which is now scheduled to terminate on October 22, 2006, be renewed for an additional two-year period.

The authority granted two years ago was intended to enable Royal Air Maroc to implement the full scope of rights provided for in the then new open skies agreement between the United States and Morocco. Royal Air Maroc currently provides direct service to New York and offers service to multiple points behind New York pursuant to its code share arrangement with Delta. The code share arrangement also makes it possible for Delta to offer service from New York to Casablanca and beyond to Agadir and Marrakech. All of this service is consistent with the US-Morocco open skies agreement.
