Requests the following and such further relief the DOT may deem appropriate; (1) to authorize it to conduct scheduled all-cargo air transportation to the points New York (through JFK International Airport) , Porto Alegre and Belo Horizonte, Brazil, in addition to the U.S., Brazil and intermediate points on its Route 695, (2) to increase AIA's authorized wide-bodied frequency allocation to 5.0 weekly flights and (3) to exempt AIA from the 90-day dormancy condition of Order 96-6-12 and Notice of Action Taken dated April 29, 1998, so that AIA's unused frequency allocation will not revert to the Department on July 29, 1998

By Order 96-6-12 the Department awarded AIA 6.5 weekly frequencies to operate all-cargo services between Miami, the intermediate point Bogota, Colombia, and the coterminal points Manaus, Sao Paulo, Recife, and Rio de Janeiro, Brazil. The award was subject to the condition that it will expire automatically and the frequencies will revert to the Department for reallocation if they are not used for a period of 90 days. On April 29, 1998, the Department granted AIA an exemption from the dormancy condition through July 29, 1998, with respect to two of its allocated frequencies. It also noted that AIA had relinquished 3.5 weekly frequencies for U.S.-Brazil services, leaving it with a total of 3 weekly frequencies. In its July 24, 1998 application, AIA requests a further exemption from the dormancy condition for 2.0 frequencies which would otherwise expire July 29. (AIA operates one frequency in the Miami-Manaus market.) AIA stated that it anticipates that its proposed services noted above will begin in mid August, thus necessitating the exemption from the dormancy condition. AIA requests the exemption for a 90-day period, (i.e., through October 27, 1998).

Challenge Air Cargo, Inc. respectfully urges the Department (i) to grant the pending application of AIA an additional 1.5 weekly wide-body scheduled all-cargo frequencies in the U.S.-Brazil market and (ii) to grant the pending application of Challenge an additional 2.0 weekly wide-body scheduled all-cargo frequencies in the U.S.-Brazil market.

Challenge Air Cargo, Inc. ("Challenge") filed an answer stating that it had intended to file an application for additional 2.5 frequencies such that the combined requests of AIA (AIA requested 2.0 additional frequencies) and Challenge would surpass the remaining 3.5 all-cargo frequency allocations. In order to avoid the need for a comparative proceeding, AIA indicated its willingness to reduce its request to 1.5 allocations and Challenge would similarly reduce its request to 2.0 frequencies.

To this end, AIA hereby amends its application in this Docket to reduce its frequency allocation request from 2.0 to 1.5. In this manner, the requests of AIA and Challenge can be accommodated within the remaining frequency allocations.

Scheduled foreign air transportation of property and mail between New York, New York, and Porto Alegre and Belo Eorizonte, Brazil, and authority to integrate these services with services authorized on AIA's certificate of public convenience and necessity for Route 695 in order to operate services in the New York-Porto Alegre/Belo IIorizonte markets directly and via points named in its certificate (between the ter ninal point Miami, Florida; the intermediate point Bogota, Colombia; and the coterminal points Manaus, Sao Paulo, Recife, and Rio de Janeiro, Brazil). ALA stated that it plans to commence service in these markets with B-747 aircraft on or about August 16, 1998, or as soon as it has obtained all necessary government approvals.
