OST-1998-3960 - Exemption - Mexico-US Charter

Aero Empresa Mexicana owns and operates a single seven-passenger Learjet 24F aircraft with Mexican registration XA-DET. Aero Empresa Mexicana presently has no plans to acquire additional aircraft, but anticipates that any such aircraft, if acquired, would be similar in size and operational capability to its present aircraft.
Answers are due by June 30, 1998

Application for Renewal of Exemption
Aero Empresa Mexicana, S.A. hereby applies for renewal of its exemption from 49 U.S.C. §41301, which authorizes Aero Empresa Mexicana to engage in charter foreign air transportation of passengers between Mexico and the United States, and other passenger charter operations in accordance with 14 C.F.R. Part 212, using small aircraft. Aero Empresa Mexicana also requests renewal of its stopover privileges and continued relief from the Department's requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States.
The Department granted the above authority to Aero Empresa Mexicana pursuant to a Notice of Action Taken dated June 22, 2005. Aero Empresa Mexicana requests that the Department renew this authority, which is scheduled to expire June 22, 2005, for a period of at least two years.
Aero Empresa Mexicana operates a single Learjet 24F aircraft that is configured for seven passenger seats.

Renewal of exemption from 49 USC 41301 to permit the applicant to conduct passenger charter operations between Mexico and the United States, and other passenger charters in accordance with 14 CFR Part 212, using small equipment. The applicant also requests renewal of its stopover privileges and continued relief from the requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States. Furthermore, the applicant requests that the authority be granted for a two-year term.
We are continuing to allow Mexican carriers conducting passenger charters using small equipment to make stopovers in the United States in the conduct of such operations. The one-year duration of the authority we granted is consistent with our usual policy of granting exemption authority in the circumstances presented. We, therefore, dismissed the application to the extent that it sought authority for a longer period.

The applicants also request renewal of their stopover privileges and continued relief from the requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States.
We note that Taxi Aereo de Veracruz, S.A. de C.V. did not request stopover privileges or relief from the requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States. We have decided to grant the applicant that authority.
Taxi Aereo de Veracruz, S.A. de C.V., Aero Quimmco, S.A. de C.V., Servicios Especiales del Pacifico Jalisco, S.A. de C.V., and Aero Empresa Mexicana, S.A. each requested that their authority be granted for a two-year term. As to the other applicants, we have decided, on our own initiative and in the interest of administrative efficiency, to grant the exemption authority for a two-year term.
