Order 2006-2-12
OST-1998-3958 - Interstate Charter Air Transportation
Issued and Served February 16, 2006
Order Revoking Certificate Authority
By Order 1999-6-15, issued June 16, 1999, we reissued to Southeast a certificate of public convenience and necessity for interstate charter air transportation of persons, property, and mail under 49 U.S.C. 41102. By Order 2001-2-11, issued December 15, 2001, Southeast was issued a companion certificate to engage in foreign passenger charter air transportation (See Docket OST-2000-7956). The air carrier operated under these certificates until November 30, 2004, when it ceased all operations.
By letter dated December 2, 2004, the Department advised Southeast that, pursuant to section 204.7, its authority was suspended and that it could not resume air transportation operations until the Department had redetermined its fitness to do so. We further stated that if Southeast did not resume operations by November 30, 2005, its authority would be revoked for dormancy. It has now been more than one year since Southeast ceased operations and we have not received an application from Southeast to have its fitness redetermined.
Under these circumstances, and in accordance with section 204.7 of our rules, we find it appropriate to revoke Southeast’s certificate authority. This action is without prejudice to the company’s filing for new certificate authority in the future.
