Application for Grant of an Exemption

Federal Express hereby applies, pursuant to 49 U.S.C. § 40109 and Subpart D of the Procedural Regulations of the Department of Transportation (the Department), for grant of an exemption from 49 U.S.C. § 41102 to authorize Federal Express to engage in scheduled all-cargo air transportation between points in the United States and points in Costa Rica, in conjunction with the existing scheduled all-cargo service provided by Federal Express between various points in the United States and various points in the Caribbean and Central and South America. Traffic will involve the operation of the 4,000-pound payload LET-410 freighter aircraft, operated for Federal Express pursuant to a cargo aircraft charter agreement by Aero Costa Sol, S.A., a Costa Rican all-cargo air carrier.

Motion of Federal Express to Dismiss Application

Federal Express has decided to restructure the operation proposed in its application and to defer prosecution of an application for Costa Rica exemption authority until such time as Federal Express is prepared to commence direct service to Costa Rica with its own aircraft.
