The purpose of this exemption is to enable Delta to take advantage of new third-country codeshare opportunities to Africa in conjunction with Air France, which have recently been made possible under the new U.S.-France MOC.

Answer of Continental Airlines
Continental is today applying for the underlying U.S.-Africa exemption authority which will enable Continental to extend its current alliance with Air France to points in Africa. Continental assumes that its and Delta's applications to serve the same points in Africa are not mutually exclusive. As a result, Continental does not oppose Delta's request for U.S.-Africa exemption authority related to its competing code-share arrangement with Air France as long as award of that authority to Delta in no way precludes or delays the Department's grant of similar authority to Continental. To the extent Continental's and Delta's applications are mutually exclusive, however, Continental's application should be granted because Delta is already code-sharing to Africa With another third-country carrier.

Continental was free to file its own exemption application for U.S.Africa code-share services via France at any time following the signing of the MOC. Continental, however, delayed filing its application until May 27 -- the date Answers were due to Delta's exemption request. The Department should immediately approve Delta's application. No mutual exclusivity issues are raised by Continental's application. Indeed, Continental concedes that "its and Delta's applications to serve the same points in Africa are not mutually exclusive." Continental's request for simultaneous approval is without merit and should be rejected. Delta is entitled to immediate approval. No one (including Continental) opposed Delta's request.

Scheduled foreign air transportation of persons, property and mail between the United States and the following African points: Luanda, Angola; Yaounde, Cameroon; Ndjamena, Chad; Libreville, Gabon; Nouakchott, Mauritania; Agadir, Marrakech, and Rabat, Morocco; Niamey, Niger; Seychelles; and Sfax, Tunisia. Delta states that it intends to use the authority to begin offering thirdcountry code-share services via France under a code-share arrangement with Air France as soon as it receives the necessary regulatory approval. Delta also requests route integration authority to permit it to combine services operated pursuant to the grant of this exemption with all other Delta services authorized by existing Department certificates and exemptions (to the extent permitted by applicable international agreements). Delta requests that the exemption be granted for an indefinite duration.

These exemptions have allowed Delta to provide third-country codeshare service between the United States and numerous foreign points in conjunction with its European codeshare partners. Delta offers third-country codeshare service to Cotonou, Benin, in conjunction Sabena, and plans to serve the other African points that are the subject of this application with its SkyTeam partner, Air France, pursuant to the Delta/Air France blanket codeshare authority issued on August 6, 1998 (#98-303). Renewal will allow Delta to resume, maintain or enhance online service between the United States and several points in Africa with respect to which U.S. carrier online service options are otherwise very limited.

Application for Renewal of Exemptions
Hereby applies under 49 U.S.C. § 40109 for renewal of Delta's exemption authorities to engage in scheduled foreign air transportation of persons, property, and mail between the United States and each of the points identified in Exhibit A. Delta also requests continuation of its authority to combine services operated under these exemptions with all other Delta services authorized by its existing certificates and exemptions, to the extent permitted by applicable international agreements.
Pursuant to these exemptions, Delta provides bilateral, third-country and intra-country codeshare service between the United States and numerous foreign points in conjunction with SkyTeam alliance partners Societe Air France, Alitalia-Linee Aeree Italiane- S.p. A., Czech Airlines, and Korean Air Lines Co., Ltd., and codeshare partners Royal Air Maroc, China Southern Airlines Company Limited, and Jersey European Airways (UK) Limited, trading as FlyBE.
In addition, on May 11, 2000, Delta filed a renewal application for its exemption authority to serve additional points in Europe, Africa and Asia on a third-country codeshare basis (Dockets OST-96-1598 and OST-96-1510); on June 20, 2003, Delta filed a renewal application for its exemption authority to serve Vietnam on a third-country codeshare basis (Docket OST-2000-7078); and on October 14, 2003, Delta filed a renewal application for its exemption authority to serve Portugal (Docket OST-99-6721). These applications remain pending. Delta urges the Department to grant renewal of these applications concurrently and coextensively with the authority requested herein, for the same administrative efficiency reasons.
