The purpose of this exemption application is to enable United to take immediate action on opportunities that present themselves under the U.S./France MOC signed on April 8, 1998 without waiting for the time -required in the processing of a formal certificate application. United is currently providing combination service with its own equipment between Paris and Chicago/San Francisco/Washington DC, and is also offering such service to Nice through a code-share with British Midland via London Heathrow. With the flexibility permitted by grant of this exemption, United will begin to explore options for increasing United's on-line combination Service to France through additional code-share service with its Europe-an partners such as British Midland, Lufthansa, and SAS. These partners serve cities in France not served by United such as Lyon, Marseille and Nice.

("United") amends its above-captioned application to include requests for (1) allocation of seven (7) U.S.-France combination service frequencies effective June 10, 1998, to enable United to implement its second daily Washington Dulles-Paris CDG nonstop service which has already been approved by both the U.S. and French governments; (2) designation for operation of thirdcountry carrier U.S.-France code-share service via an intermediate country in conjunction with Lufthansa German Airlines via Germany; and (3) exemption and designation to operate all-cargo service between the U.S. and France (including Paris) effective immediately.

Given this protracted schedule, it seems clear to us that unless our Government is willing to allow most of the long-sought and hard-fought-for additional France frequencies to lie fallow for upwards of another year -- throughout both the summer of 1998 and the winter of 1998-99 -- at least the first part of the decision it must make is easy: grant the requests of United and Tower Air for immediate use of eleven frequencies.

The proposed service will not only bring needed additional capacity, it will provide service choices for travelers and shippers. United will provide a later departure, 9:20 p.m., which will be a meaningful alternative to the current non-stop services to Paris. This later departure provides significant advantages for the local Washington market. Passengers will be able to work a full business day in Washington, leave for Washington Dulles from work or from home, and arrive in Paris at a convenient hour. Cargo customers will be able to take advantage of later freight delivery times to the airlines, thus providing a full day to prepare freight for shipment that will still arrive in Europe the next business day.

These frequency allocations, both of which concern services proposed to begin in 1998,are effective immediately. We also defer action on the applications of US Airways, Inc., and American Airlines, Inc., so that we may consider them in a soon-to-be instituted allocation proceeding regarding 1999 U.S.-France services.

Conduct scheduled combination air services between points in the United States and France via Germany on a blind-sector basis under a code-share arrangement with Lufthansa German Airlines. United states that initially it would offer codeshare services to six points in France, Paris (CDG), Paris (ORY), Nice, Toulouse, Lyon and Marseille) via three points in Germany (Frankfurt, Munich, and Dusseldorf). United states that it would not hold out code-share service between New York and Paris via points in Germany because it lacks the underlying route authority to offer service in that city pair. United further requests that this application serve as the required notice under the blanket statement of authorization granted Lufthansa by Order 98-4-8 of the United/Lufthansa U.S.-Germany-France "via third-country" code-share services.

By Order 98-6-5, the Department granted United's exemption authority to operate scheduled combination services between, inter alia, any point or points in the United States, and any point or points in France, directly and via intermediate points, and beyond France to any point or points in third countries. The exemption authority was granted May 8, 1998, for a period of two years, and is currently set to expire on May 8, 2000.  Renewal of United's authority is clearly in the public interest. This expanded U.S.-France route authority allows United to offer service code-share service between the U.S. and additional points in France pursuant to its alliance with Lufthansa. Such alliances offer additional online service choices to points in France and provide important competition with other alliances serving the U.S.-France market, particularly that of Delta and Air France.

By this application, United seeks to renew each of the above-detailed exemption authorities for a minimum period of two years or until the Department grants United's corresponding applications for a certificate of public convenience and necessity, as amended, currently pending in Dockets OST-95-625, OST-98-3853 and OST-99­6385. United also requests that the Department give each of the above-detailed exemption authorities a common expiration date so there will not be a need for multiple renewals.  In the case of United's exemption in Docket OST-99-5097 to serve Windhoek, Namibia, via points in Germany, United requests an amendment to include the right to operate via any intermediate points in third countries which United is authorized to serve. Such an amendment would give United additional flexibility to serve Windhoek consistent with its broad exemptions in other markets.

United wishes to clarify its renewal request with respect to Dockets OST­99-5097 (U.S.-Namibia) and OST-99-6720 (U.S.-Accra, Ghana, and U.S.-Lagos, Nigeria). United seeks renewal and amendment of the authority to operate these services pursuant to authorized code-share arrangements with any of its foreign code-share partners, not just Lufthansa. In Notice of Action Taken dated July 13, 2000 (Docket OST-99-6720) and Notice of Action Taken dated February 7, 2001 (Docket OST-99­5097), exemption authority was granted to perform the above services. Both notices state that United intends to operate or will operate this service under a code-share arrangement with Lufthansa. United believed that this wording describing its initial plans for providing these services was merely illustrative and did not restrict United's ability to code share with any of its foreign partners. United wishes to clarify for the record its intention in the renewal and amendment application dated January 23, 2002, to seek the flexibility to offer services to these points in conjunction with any of its authorized code­share partners.

In addition, United also wishes to clarify that it seeks authority to integrate its U.S.-Lagos/Accra exemption authority in Docket OST-99-6720 with other outstanding certificate and exemption authority. The Notice dated July 13, 2000 in that docket refers to route integration authority "by virtue of either the present action or other action of the Department." Because that Notice itself contained no specific route integration authority, United urges that the U.S.-Lagos/Accra authority, as renewed, specifically contain the Department's standard route integration provision applicable to exemption authority.
