Grant of the application will extend TWA's route network to important Middle Eastern and Asian countries, and will enable TWA to provide a comprehensive pattern of service to this area of the world. TWA already serves Egypt, Saudi Arabia, Jordan, and Israel. The addition of service to the points listed above will allow it to provide additional routings to passengers to the Middle East and Asia, and will expand US flag competition for traffic to that part of the world

Scheduled foreign air transportation of persons, property, and mail between New York, New York, on the one hand, and Delhi and Calcutta, India; and Karachi, Pakistan, on the other. TWA further requests authority to integrate this exemption with authority under its existing certificate for Route 147. TWA intends to operate between New York, on the one hand, and Delhi and Calcutta, India; Karachi, Pakistan; Aqaba, Jordan; Doha, Qatar; and Bahrain, on the other, under a code-share arrangement with Alia-The Royal Jordanian Airline on flights operated by Alia.

Pursuant to the authority granted above, TWA has instituted code share service with Royal Jordanian. TWA currently provides service on the New York - Amsterdam -Amman routing five times weekly. It has been unable to institute service to India because of difficulties with the Government of India, which has refused to accept assurances by Jordan that it would allow code share operations by Indian carriers. TWA is working with the U.S. Government to resolve this problem. TWA has instituted service to the other code share points beyond Amman, except for Aqaba, where current service does not provide useful connections. TWA, nevertheless requests renewal of the Aqaba authority because it is working with Jordanian to improve connections and my place its code on the Amman - Aqaba flight within the next few months.

On October 16, 1998, Continental submitted to Jordan s Civil Aviation Authority an application for code-sharing with Air France between the United States and Amman via Paris. Although the bilateral agreement between the United States and Jordan explicitly permits such third-country code-sharing, the Government of Jordan denied the application because the bilateral agreement between Jordan and France does not address third-country code-sharing. (See Attachment A) When Russia refused to approve United's third-country code-share services because they were not permitted under an agreement between Germany and Russia. the Department found that Russia had violated IATFCPA. The retention of limited-entry code-share authority between the U.S. and India by TWA and Royal Jordanian is particularly egregious. Code-share opportunities in limited-entry markets should be withdrawn from foreign airlines whose home countries are denying U.S. carriers their bilateral rights. TWA is currently the fourth and final carrier that can be authorized to code-share under the U.S.-India agreement.

The retention of limited-entry code-share authority between the U.S. and India by TWA and Royal Jordanian is particularly egregious. Code-share opportunities in limited-entry markets should be withdrawn from foreign airlines whose home countries are denying U.S. carriers their bilateral rights. TWA is currently the fourth and final carrier that can be authorized to code-share under the U.S.-India agreement. Although Continental and Air France applied for India code-share rights, the Department denied the application because the United States and France did not have an agreement that authorized such code-share services at that time. After the U.S. and France had reached an agreement permitting such code-share services. Continental sought TWA's unused authority to provide U.S.-India code-share service via Paris in conjunction with Air France Based on TWA's commitment to institute India code-share service with Royal Jordanian by October 25, 1998, the Department allowed TWA to retain the authority.

Continental, which desires to take over TWA's designation, also complains that TWA has not yet instituted code share service to India with Royal Jordanian. However, as the Department well knows, TWA has been unable to start code share service to India because of the intransigence of the Indian government, which has not only rejected TWA's code share application, but has also refused to accept Jordan's assurance that it would grant Indian carriers reciprocal code share privileges. TWA intends to institute code share service to India as soon as it receives approval from the Government of India. There is no basis for withdrawing TWA's designation, particularly when there is no assurance that India would accept a code share over Paris without raising the same objections. The retention of the code share designation to India is extremely important to TWA, which has far fewer code share opportunities that Continental. Continental can code share with Air France to points throughout Europe, Africa, and Asia. It would be unfair to deprive TWA of one of its limited code share opportunities when Continental has numerous other points to which it can provide code share service.

Royal Jordanian Airlines hereby submits this motion for leave to file and reply to the answer of Continental Airlines filed on February 19, 1999, to the above captioned applications of Trans World Airlines and Royal Jordanian for exemption authority and Statements of Authorization to provide code share services. Royal Jordanian urges the Department of Transportation to deny Continental's general request to terminate the TWA - Royal Jordanian code share Statements of Authorization and its specific request to withdraw third country code share authority to India.
