American and Aero California are aware that U.S. and Mexican aviation authorities have not to date reached agreement with respect to the designation of carriers to provide codeshare services so as to permit the full effectuation of their codeshare agreement. American and Aero California trust that Mexicana, which is commonly controlled with Aeromexico and which is partly owned by the Mexican government, will work with the appropriate authorities in Mexico to bring about the policies necessary so that travelers on both sides of the border will be able to benefit from the wider range of competitive codeshare services that would be offered by full approval of the American/Aero California and United/Mexicana arrangements.

Answer of Delta Air Lines

In the event carrier selection proceedings are necessary, Delta would demonstrate the superior public benefits of its proposal that warrant selection over United in U.S.-Mexico city-pairs where designations are limited. Delta is aggressively expanding its presence in Central America, and enhanced service to Mexico in conjunction with Aeromexico is an important part of Delta's regional expansion plan. By contrast, United has dismantled its Miami-Central America operation in the face of competition by American. Awarding Delta enhanced U.S.-Mexico code-sharing authority will maximize both U.S.-Mexico and U.S.Latin America service and competitive benefits.

With respect to the balance of the United/Mexicana application -- i.e., those portions involving services to behind gateway points via connections at U.S. or Mexican gateways -- a deferral would be appropriate for the same reason United has urged that the similar blanket applications of American/Aero California and Delta/Aeromexico should be deferred. Assuming that the U.S. and Mexico are able to reach an agreement at the January 23, 1998, talks relating to code-share designations, this deferral need not be of long duration.

US-Mexico Codesharing

The Department has imposed an informal moratorium on the expansion of U.S.-Mexico transborder code shares involving U.S. and Mexican carriers pending bilateral resolution of code-share issues between the two governments. However, the Department recently granted a similar request by Delta and Aeromexico stating that, "in deferring action on pending requests, it was never our intent to affect adversely existing services that we had already found to be in the public interest." The instant motion for immediate action does not involve any expansion of United's transborder code-share services, but only a continuation of such services for which United already holds a designation. Unless this motion is granted, United will be forced to discontinue services to Huatulco which the Department has already determined to be in the public interest. To avoid that result, United and Mexicana urge the Department to grant their pending joint application in this proceeding to the limited extent requested above. Because United is already designated for both the Chicago-Huatulco and Los Angeles-Huatulco city pairs, there is no mutual exclusivity and no other pending applicant for authority to serve these markets would be prejudiced by grant of the instant motion.

OST-97-3237 January 25, 1999 Answer of American Airlines to Motion for Immediate Action US-Mexico Codesharing

As United and Mexicana acknowledge, "[t]he Department has imposed an informal moratorium on the expansion of U.S.-Mexico transborder code shares involving U.S. and Mexicana carriers pending bilateral resolution of code-share issues between the two governments" However, they urge that their request should fall outside the moratorium because Mexicana is proposing to operate the Mexico City/Huatulco segment in place of Transportes Aeromar, a commuter carrier with which United had a prior codeshare arrangement.

The Department should reject such an argument. Authorizing large jet operations by Mexicana in place of commuter service by Transportes Aeromar would be a material change that should only be authorized under a new codesharing provision. in the U.S.-Mexico Air Transport Agreement. As the Department well knows, Mexicana and Aeromexico, as part of the Cintra Group, have been the principal impediment to the negotiation of such a bilateral provision. If the Department continues to grant extrabilateral authorizations to the benefit of Mexicana and Aeromexico, those carriers will have no incentive to urge the Government of Mexico to conclude a bilateral agreement: with the United States.

Exemption for United under 49 U S. C §40109 to provide the following service: Scheduled foreign air transportation of persons, property and mail between Los Angeles and Chicago, on the one hand, and Huatulco, Mexico, on the other hand, via Mexico City under a code-share arrangement with Mexicana. 

Statement of Authorization for Mexicana under Part 212 to: Permit Mexicana to display United's airline code on flights operated by Mexicana between Mexico City and Huatulco, for the carriage of United's traffic moving between Los Angeles and Chicago, on the one hand, and Huatulco, Mexico, on the other hand beyond via Mexico City.

In regard to American's answer, we noted that on January 26, 1999, the United States and Mexico signed an ad referendum agreement on bilateral code-share services that significantly expands the operations that can be conducted, including the beyond-gateway code-sharing services at issue here. In these circumstances, we determined that the grant of the requested authority for the beyond-Mexico City code-share services was in the public interest.

United and Mexicana file this supplement to clarify that they also seek the underlying exemption authority necessary to engage in interior starburst code-sharing. Although a request for underlying exemption authority for interior code sharing is effectively contained in the United/Mexicana initial application pending in Docket OST-97-3237, the original request detailed specific interior points to which the parties sought to code-share. If, however, the Department is prepared to grant blanket interior exemption authority for code-share purposes, such as that requested by American and Aero California in Dockets OST-97-2477 and OST-99-5113, the Department also should grant blanket exemption authority of the same scope to United and Mexicana., consistent with the terms of the U.S.-Mexico Air Transport Agreement, as amended.

United was authorized by exemption to serve the following city-pair markets: Chicago-Guadalajara, Denver-Mazatlan, Denver-Puerto Vallarata. Denver-San Jose del Cabo (Los Cabos), Los Angeles-Cancun, Miami-Cozumel. San FranciscoGuadalajara and San Jose-Guadalajara.' United also received exemption and route integration authority to serve the following behind-gateway points via Mexico City, connecting with flights from United's U.S. gateways (Chicago. Denver, Los Angeles, Miami, San Antonio, San Francisco and Washington, D.C. ) operated by United or on a code-share basis with Mexicana: Acapulco, Cancun, Guadalajara, Merida, Puerto Vallarta and Ixtapa/Zihuatanejo.3 United's exemption authority was granted June 24, 1997, for a period of two years, and is currently set to expire on June 24, 1999.

Immediate action on (1) their joint application in Docket OST-97-3237, as amended February 12, 1999, and supplemented February 22, 1999, for expanded U.S.-Mexico code-share authority; and (2) United's application dated May 20, 1998, for a statement of authorization to code share for Mexicana on a blind sector basis on United's flights between Chicago, Illinois and Toronto, Canada. United and Mexicana understand that these authorizations have been delayed pending the Department's review of its policy concerning contractually agreed exclusivity provisions contained in carriers' code-share agreements. On May 3, 1999, the Department issued an order providing additional guidance on this subject (Order 99-5-2). Consistent with the policy announced in that order and the January 26, 1999 amendment to the U.S.-N4exico air transport agreement, United and Mexicana submit that their applications for expanded U.S.-Mexico code-share authority should be promptly approved without any condition on the carriers' right to enforce their contractual exclusivity provision.

The immediate grant of codeshare authority for Delta to list Aeromexico’s code on Delta’s new Atlanta-Guadalajara nonstop flights is particularly urgent because the new service is scheduled to begin on July 1, 1999. Without the additional codeshare traffic generated by Aeromexico, the economic viability of this service would be substantially impaired.

In conclusion, United and Mexicana strongly urge the Department to reconsider its action in conditioning the exclusivity term of the United/Mexicana code-share arrangement. On reconsideration, United urges the Department to reverse that action in light of the vigorous competition that characterizes the U.S. -Mexico transborder market and the broad opportunities for expansion of U.S. -Mexico competition. Given the foregoing, there is no need to condition the exclusivity provision of United/Mexicana code share and certainly no need to condition it more strictly than is the case with respect to the condition applicable to the code share between Northwest and Air China.

For the reasons contained in Delta’s own Petition for Reconsideration filed on June 22, 1999, there is no basis in law, policy or fact to support the Department’s imposition of a prohibition against exclusivity clauses in U.S.-Mexico codeshare arrangements. As Delta and United/Mexicana demonstrated, U.S.-Mexico is an extraordinarily open and competitive air transportation marketplace. Moreover, codesharing under contracts which provide for exclusivity have been in the U.S.-Mexico marketplace for several years without any adverse competitive impacts.

We reject arguments that we should adopt a laissez-faire approach to exclusive dealings between and among airlines in international air transportation. It is not in the public interest to ignore any feature of a code-share agreement that could interfere with competition or otherwise undermine the ability of consumers to benefit from the opportunities created by our aviation relationships. For that reason, we will continue to assess the merits of code-share exclusivity provisions on a case-by-case basis in light of the terms of the overall arrangement and of the special facts and circumstances affecting each market, such as its structure, the positions of the parties in those markets, and the nature of the bilateral aviation relationship governing it.

Effective December 17, 1999, United will place its two-letter designator code on Mexicana’s nonstop flights operated between Chicago (O’Hare) and Monterrey, Mexico, and between Denver and Zacatecas, Mexico. Mexicana’s Denver-Zacatecas flight will additionally operate beyond Zacatecas to Leon, Mexico, carrying United’s designator code on the intra-Mexico Zacatecas-Leon segment. February 24, 2003 Application for Renewal of Exemptions US-Mexico

Provide scheduled foreign air transportation of persons, property and mail in certain U.S.­Mexico transborder markets and to points within Mexico beyond United's authorized Mexican gateways. United currently serves these markets pursuant to a code-share arrangement with Compania Mexicana de Aviacion, S.A. de C.V. 

By Notice of Action Taken dated April 26, 2001, in Docket OST-96-1988, the Department renewed United's exemption to serve the following city pairs for the purpose of code sharing on flights operated by Mexicana: Chicago-Guadalajara, Denver­Puerto Vallarta, Denver-San Jose del Cabo, Los Angeles-Cancun, San Francisco-Guadalajara and San Jose-Guadalajara.) United's exemption authority was issued for a two year period and is currently set to expire April 26, 2003.  By the same NOAT, the Department renewed United's exemption authority for the Denver-Mazatlan city pair, but United does not seek to renew this exemption because the authority has become dormant and reverted to the Department.

By Notice of Action Taken dated April 26, 2001, in Docket-OST-97-3237, the Department renewed United's exemption to engage in scheduled foreign air transportation of persons, property and mail in the following transborder markets for the purpose of code sharing on flights operated by Mexicana: Chicago-Morelia, San Francisco-Morelia, Chicago-Puerto Vallarta, Los Angeles-San Jose del Cabo, Los Angeles-Guadalajara, Miami-Cancun, New York/Newark-Mexico City, Oakland­Guadalajara, and San Antonio-Mexico City. United's exemption was granted on April 26, 2001, and is currently set to expire on April 26, 2003.

Re: Joint Notification of Termination of Codeshare and Regulatory Cooperation Agreement

In accordance with the terms of the Department of Transportation's approvals of the statements of authorization in the above‑captioned dockets, Compania Mexicana de Aviacion, S.A. de C.V. and United Air Lines, Inc. hereby notify the Department of the expiration of their Codeshare and Regulatory Cooperation Agreement effective November 15, 2003. As a result of the Agreement's expiration, all codeshare services operated by Mexicana and United will be discontinued effective March 31, 2004, and the related statements of authorization cease to be effective after that date. This notice applies only to the statements of authorization issued in the above referenced dockets and not to any exemptions granted to United or Mexicana in those dockets or any other docket.
