Re: Correction to Application

Attached is a revision to the above-captioned Application of Northwest Airlines, Inc. to reflect Sylvia Moore's request to assign a new docket number. When Northwest's Route 378 Certificate was reissued adding Segment 2 by Order 96-10-44 in Docket OST-95-969, it appeared that Segment 1 was consolidated into this docket as well. Please remove the above-captioned filing from Docket OST-95-969 and assign a new docket number to the attached.

Application for Renewal of Segment 1 of Route 378 Certificate

Hereby requests that the Department renew Segment 1 of Northwest's Route 378 Certificate of Public Convenience and Necessity. Northwest also requests that the Department integrate this certificate authority with all of Northwest's existing certificate and exemption authority to the extent consistent with US bilateral agreements and DOT policy. Segment 1 of Northwest's Route 378 Certificate authorizes Northwest to engage in scheduled foreign air transportation of persons, property, and mail between Chicago, Los Angeles, San Francisco, Seattle, and Honolulu, on the one hand, and Shanghai, Guangzhou and Beijing, Peoples Republic of China, on the other hand, via Japan.

Segment 2 of Northwest's Route 378 Certificate, which is not the subject of this Application, authorizes Northwest to operate between Detroit and Beijing. Northwest also holds authority to integrate Route 378 with all Northwest's certificates and exemptions issued by the Department. See Order 2001-12-8 (OST-95-969, issued October 10, 2001) and NOAT issued November 11, 2002 (OST-2000-8119).

Answer of United Air Lines

United has also filed an application for renewal of its own U.S.-China route authority. United's authority appears in its Certificate of Public Convenience and Necessity for Route 246. Although United's renewal application was filed nearly a year ago and was unopposed, the Department has taken no action to renew United's authority United's Certificate continues in effect under 5 U.S.C. §558(c) pending a final order by the Department. See Application of United, dated September 16, 2002, in Docket OST-97-3020.

Both carriers seek renewal of authority which they are currently using to operate scheduled air transportation services between the U.S. and China. United also requested amendment of its route authority to conform to the full scope of operations permitted by the bilateral air services agreement between the United States and the People's Republic of China. There is nothing controversial in United's amendment request (which was unopposed by any party), and there is no apparent reason why the Department's action on United's September 16, 2002, application has been delayed.
