Immediately upon receiving this authority, AIA began the process of applying to the Ecuadorian civil aviation authorities ("DGAC") for an operating permit. This matter is being handled by the company's counsel in Quito. Counsel has confirmed, however, that the DGAC has not yet rendered a decision on the application. While the company had anticipated receiving its authority by this time, it does not appear that it will be in a position to inaugurate service by November 20. Thus, to avoid loss of its route authority, AIA requests an extension of the 90-day dormancy period by an additional 60 days, or until January 19, 1997. AIA intends to begin its scheduled service as soon as possible after receipt of its Ecuadorian authority.

By Order 97-8-20 the Department granted American International Airways exemption authority to provide scheduled all-cargo service in the U.S.-Ecuador market and allocated it three weekly allcargo frequencies for this service. That award was subject to the condition that it win expire automatically and the frequencies win revert back to the Department for reallocation if they are not used for a period of 90 days. Under the terms of the order AIA's frequency avocation would expire November 20, 1997, if AIA did not begin service by that date. AIA seeks exemption from that condition to the extent necessary to extend its proposed start-up date to January 20, 1998. AIA states that because of delays in completing operational arrangements, including the necessary licenses from the Ecuadorian government, the optimum date to commence its operations is January 20, 1998.

By Order 97-8-20 the Department granted American International Airways exemption authority to provide scheduled all-cargo sernce in the U.S.-Ecuador market and allocated it three weekly allcargo frequencies for this service. That award was subject to the condition that it will expire automatically and the frequencies will revert to the Department for reallocation if they are not used for a period of 90 days. Under the terms of the order AIA's frequency allocation would expire November 20, 1997, if AIA did not begin service by that date. On November 13, 1997, A1A applied for an exemption to extend its November 20, 1997, startup date to January 20, 1998. By Notice of Action Taken dated November 19, 1997, the Department granted the extension. (See Order 97-12-15.) AIA seeks extension of the January 20 startup date to April 20, 1998. AIA believes that the necessary approvals by the Ecuadorian authorities will be secured by April 20, 1998.

Until the DGAC issues its permit, AIA will not be in a position to inaugurate service. While this permit likely will be issued before the end of April, unforeseen delays may arise. Therefore, to avoid the loss of its route authority, and out of an abundance of caution, AIA requests a 60-day extension of time, to June 19, 1998, to begin service. AIA expects to inaugurate this service as soon as possible after receipt of the Ecuadorian authority.

Despite the substantial progress AIA has made toward obtaining its operating permit, that permit has still not been issued. AIA has established the requisite Ecuadorian subsidiary, and has provided extensive technical documentation to the DGAC. The Civil Aviation Council has informed the carrier that it has agreed to grant AIA its operating authority. Some differences have arisen, however, over the technical supporting material that has been requested by the DGAC; the agency continues to request additional manuals. AIA is now attempting to comply with the request; while the carrier had expected that this process would have been completed prior to June 19, it is apparent that this will not be possible. AIA expects, however, that the permit will be issued very shortly after the material has been received.

AIA hereby requests renewal of its exemption authority to provide scheduled foreign cargo air transportation between Miami and Quito and Guayaquil, Ecuador, renewal of allocation of its three all-cargo frequencies, and further limited relief from the 90-day start-up requirement. AIA still expects to operate the scheduled service to Ecuador for which it has been authorized and designated. In order to do so, however, it will be necessary for the Department to renew the one-year exemption and the allocation of three all-cargo frequencies awarded in Order 97-8-20. This authority is now set to expire on August 21, 1998. In addition, relief from the 90-day start-up requirement expires on August 19, 1998. It would be in the best interest of the public to renew the authority in issue (and grant the requested start-up waiver) to permit AIA to complete its Ecuadorian regulatory processes and begin its planned service.
