Motion to Consolidate of Delta Air Lines

Delta plans to provide daily nonstop service between Atlanta and Lima beginning on or about 90 days after receipt of U.S. and foreign governmental approvals. Delta proposes to use Boeing 757 aircraft. An award to Delta of Atlanta-Lima authority would provide significant new service benefits and enhance the competitive market structure between the United States and Peru. Nonstop service between the United States and Peru is available from only four U.S. gateways (New York, Dallas/Ft. Worth, Houston and Miami). The creation of a new gateway at Atlanta -- the largest airline hub in the world and the centerpiece of Delta's Latin America expansion program -- will provide significant public benefits through enhanced intergateway competition with American's hubs at Miami and Dallas/Ft. Worth, Continental's hubs at Houston and Newark, and United at Miami. The addition of a fifth hub gateway that would be geographically complementary to American's existing southern-tier gateways at Dallas/Ft. Worth and Miami, and to Continental's Houston and Newark gateways, would dramatically expand network competition among U.S. carriers for U.S.-Peru traffic.

American's opposition to Delta's Motion to Consolidate is without merit. Delta hereby adopts and incorporates by reference, the Surreply it is concurrently filing in Docket OST-97-3073. American's proposal to utilize additional U.S.-Peru frequencies is mutually exclusive as a matter of law and fact to Delta's request for allocation of U.S.-Peru frequencies to permit it to operate Atlanta-Lima nonstop service. That mutual exclusivity requires the Department to consider the Delta and American proposals for additional U.S.-Peru service in a contemporaneous carrier-selection proceeding.

We strongly urge the Department to proceed to consolidate the American and Delta applications and begin a route proceeding to determine which application would better serve the public interest. Service via Delta's Atlanta hub would add a tremendous competitive spur and provide significant new connecting service to the entire United States. The Delta hub offers 800 flights per day to 139 nonstop destinations. That is well in excess of connecting opportunities at either American's Dallas-Fort Worth or Miami hubs, Continental's Houston or Newark hubs and United at Miami.

Continental urges the Department to defer action on Delta's motion to consolidate unti] the Department determines how many additional U.S.-Peru frequencies are available for U.S. carriers and invites applications for any available frequencies from other U.S. carriers. Only then should the Department issue an order instituting a competitive carrier selection proceeding consolidating all applications for the frequencies. In the meantime, the Department should determine whether American's activities in Peru violate the Logan Acts and whether American is currently operating flights exceedingapplicable frequency limits.

Delta requests allocation of the seven (7) weekly frequencies available for scheduled combination services by a U.S. carrier between the United States and Peru to enable Delta to operate daily nonstop service between Atlanta and Lima.
The Department's Notice indicated that the additional frequencies will become available "no earlier than June 1998." Accordingly, Delta's proposed start-up date will be in June 1998, or within 90 days of the service date of a final order granting Delta's request for route authority and frequencies, whichever is later. Delta further requests that the Department immediately grant, on a pendente late basis, the allocation of seven frequencies and an exemption authorizing Delta to serve Atlanta-Lima, pending final action on Delta's certificate application and a final determination on the long term award of frequencies. The public interest fully supports the grant to Delta of an immediate frequency allocation and exemption. The recently announced frequency opportunities will enable Delta to implement daily Atlanta-Lima nonstop service.

Delta states that it plans to begin the Atlanta-Lima service with B-757 aircraft in June 1998, or within 90 days of the service date of a final order granting Delta's request for route authority and frequencies, whichever is later.

By Notice of Action Taken dated February 20, 1998, as confirmed by Order 98-7-21. the Department granted Delta an exemption and allocation of seven weekly frequencies allowing Delta to engage in scheduled foreign air transportation between Atlanta and Lima for a one year period expiring February 20, 1999. Pursuant to this authority, Delta provides daily nonstop service between Atlanta and Lima using Boeing 757-200 equipment.

By Notice of Action Taken dated February 20, 1998, as confirmed by Order 98-7-21, the Department granted Delta an exemption and allocation of seven weekly U.S.-Peru combination frequencies authorizing Delta to provide daily scheduled service between Atlanta and Lima. By Notice of Action Taken dated January 12, 1999, the Department renewed Delta's Atlanta-Lima exemption for a period of two years and Delta's frequency allocation for an indefinite period (provided that Delta continues to hold underlying Atlanta-Lima route authority). Pursuant to this exemption authority and frequency allocation, Delta has provided daily nonstop service between Atlanta and Lima on a continuous basis using Boeing 757-200 equipment.

Application for Renewal of Exemption
Delta's U.S.-Peru exemption authority was last renewed (and amended) by Notice of Action Taken dated November 12, 2002, and is set to expire on November 12, 2004. Delta requests renewal of this authority for a period of at least additional two years or until 90 days after the Department's final determination on Delta's application for U.S.-Peru certificate authority pending in Docket OST-99-6246, whichever occurs earlier.
Delta has continuously provided daily nonstop service between Atlanta and Lima. Delta also provides third‑country codeshare service to Lima via Mexico City in conjunction with Aerovias de Mexico, S.A. de C.V.
