OST-1997-3006 - Exemption - Finland-US
It is Finnair's intention here to ask the Department to award it exemption authority of such breadth and scope to allow it to have access to all the authority available under the Agreement. While Finnair is requesting authority to serve all U.S. points with all the operational flexibility available under the Agreement, its immediate intention is to serve directly only three new U.S. terminal points -- Chicago, Atlanta and Washington -- which will be served immediately through the most recent expansion of the Finnair/Delta code-share agreement referred to above. In providing its expanded service to the United States, Finnair will rely upon Delta or will use its own employees and its own equipment. Finnair will use its MD-11 equipment or other equipment it may acquire.
Finnair is presently providing scheduled service in the U.S. - Finland market between Helsinki, on the one hand, and Miami, New York, and San Francisco, on the other hand. It also provides charter service between points in Finland and points in the United States as the need arises. It conducts its business in the U.S. and provides all its services with its own personnel and its own equipment which is operated and maintained by its own employees.

Order Granting Exemption and Deferring Action on Request for Foreign Air Carrier Permit
We grant the request Finnair OYJ d/b/a Finnair OYJ and/or Finnair Cargo OY for an exemption under 49 U.S.C. §40109 to permit it to engage in: (a) foreign scheduled and charter air transportation of persons, property and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; (b) foreign scheduled and charter air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; (c) foreign scheduled and charter cargo air transportation between any point or points in the United States and any other point or points; (d) other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department’s regulations; and (e) transportation authorized by any additional route rights made available to European Community carriers in the future.
To the extent not acted upon above, we dismiss all requests for exemption authority in this
Docket (OST-1997-3006).
We defer action on the request of Finnair OYJ d/b/a Finnair OYJ and/or Finnair Cargo OY in this Docket for a foreign air carrier permit.

On March 7, 2008, Finnair OYJ made a timely application in the above-captioned docket for a renewal (and amendment) of its exemption authority and for a foreign air carrier permit to encompass the full scope of rights made available by the U.S.-EU open skies agreement.
Finnair has polled all interested parties, and no party has objected to the Application. For this reason, Finnair respectfully requests that the Department promptly grant the requested authority.

Finnair continues to be financially qualified to perform the services described in its Application. The carrier's parent company, Finnair Group, posted an operating profit of USD13.7 million for the First Quarter 2008 and held cash and cash equivalents totaling USD221.5 million at the end of the quarter. See Interim Report for the Finnair Group for the First Quarter 2008 (attached).
Also, Finnair remains substantially owned and effectively controlled by citizens of Finland. The Finnish Government continues to be the carrier's majority shareholder, with 55.81% of the company's outstanding shares. See List of Major Shareholders (May 2008) (attached); see also http://www.finnairqroup.com/investors/investors 4.html (describing the airline's snares and shareholders as of the end of its most recent fiscal year in September 2007). The remainder of its shares is traded publicly on the Helsinki Exchanges, with no other entity or person having a shareholding amounting to 5 percent or more.

By application filed April 22, 2008, as supplemented July 7, 2008, Finnair OYJ d/b/a Finnair OYJ and/or Finnair Cargo OY, a foreign air carrier of Finland, requested a foreign air carrier permit to engage in: (a) foreign scheduled and charter air transportation of persons, property and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; (b) foreign scheduled and charter air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; (c) foreign scheduled and charter cargo air transportation between any point or points in the United States and any other point or points; (d) other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department’s regulations; and (e) transportation authorized by any additional route rights made available to European Community carriers in the future.
No answers were filed to the application.
We direct all interested persons to show cause why our tentative decision on the application of Finnair OYJ d/b/a Finnair OYJ and/or Finnair Cargo OY for a foreign air carrier permit should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

By Order 2008-7-13, issued July 8, 2008, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 U.S.C. §41307) which would make final the findings and conclusions of the Order.
No objections were received within the time period provided.
