Application
for Exemption Authority
Applies for an exemption from 49 U.S.C. 41301 so that Lufthansa may enjoy the full extent of the operating authority guaranteed to German carriers by the U.S-Germany Open Skies Agreement concluded in May 1996. This exemption authority will enable Lufthansa to engage in, inter alia, proposed code share arrangements with Scandinavian Airlines System (SAS) and Atlantic Coast Airlines (ACA), each of which is tentatively scheduled to commence on October 26, 1997.
Lufthansa has delayed submitting its application to the Department for the reissuance of its foreign air carrier permit pending the completion of its privatization later this year.

Lufthansa also holds the above-described exemption authority. This authority was most recently renewed by the Department on October 24, 2002 for a two-year period. Notice of Action Taken dated October 24, 2002. The basis for approval was the United States-Germany Open Skies Agreement dated February 29, 1996.
