Application Pursuant to Subpart Q for a Certificate of Public Convenience and Necessity

PAI intends to operate charter flights within the United States, its territories and possessions and to a variety of foreign destinations, as requested by charter operators, using Boeing 727 aircraft. PAI also expects to enter into charter agreements with charter operators for ad hoc charters serving the Bahamas and other Caribbean markets during its first year of operations.

PAI expects to operate 64 total block hours per month, or 761 hours annually. PAI expects that spare aircraft time will allow it to operate ad hoc single entidy public charters between various points in the US and other gambling locations in the Bahamas, Gulfport and Las Vegas.

We are currently reviewing the fitness of Planet Airways, Inc., to conduct interstate and foreign charter passenger operations as a certificated air carrier. Planet Airways, incorporated within Florida in 1995, holds no DOT or FAA economic or operating authority. Planet Airways indicates that if granted the charter authority it requests, it will commence charter passenger operations using initially one 128-seat Boeing 727100 aircraft. Planet Airways also indicates that it plans to add a second Boeing 727 aircraft during its second year of operations based on market conditions and expansion needs at that time. During the first year, the applicant states that it proposes to operate charter track programs on behalf of charter operators and casinos (Atlantic City), and, in addition, plans to operate single entity public charters between various points in the United States and other gambling locations in the Bahamas, Gulfport, and Las Vegas. Planet Airways' FAA Certification Unit Chief is Mr. Dorvin Hagen located at the Orlando Flight Standards District Office.

Planet confirms that it will use a B-727-100 aircraft for its operations. The aircraft will be configured with a 108-seat configuration. Planet's board of directors will continue to consist of three members, Louis Perlman (chair), Peter V. Garrambone and Anthony DeCamillis. These three individuals will each hold one-third of the shares of Planet Airways. Compliance disposition statements for Mr. Holt, Mr. Boudrie and Mr. Sicular are set forth as Exhibit A. Also included is a resume for Mr. Boudrie. A statement of confirmation with respect to the line of credit held by Planet is set forth as Exhibit B. Planet respectfully seeks waiver of the Department's requirements with respect to the waiting period between the time Planet's op-specs are issued by the FAA and the time the Department makes Planet's certificate effective.

Order Revoking Certificate Authority

By Order 1998-7-14, issued July, 22, 1998, the Department found Planet Airways fit, willing, and able to conduct interstate charter air transportation as a certificated air carrier and issued to it a certificate of public convenience and necessity. By Order 2000-7-24, issued January 6, 2000, Planet Airways’ interstate charter certificate authority was made effective and we reissued Planet Airways’ interstate certificate to reflect its effective date. The carrier provided service under that authority until May 13. 2005, when it ceased all operations.

By letter dated May 13, 2005, the Department advised Planet Airways that, pursuant to section 204.7, its authority was suspended and it could not resume air transportation operations until the Department had redetermined its fitness to do so. We further stated that if Planet Airways did not resume operations by May 13, 2006, its authority would be revoked for dormancy. It has now been more than one year since Planet Airways ceased operations and we have not received an application from Planet Airways to have its fitness redetermined.

We revoke the certificate of public convenience and necessity issued to Planet Airways, Inc., as amended and reissued by Order 2000-7-24 authorizing it to engage in interstate charter air transportation of persons, property, and mail.

We revoke the certificate of public convenience and necessity issued to Planet Airways, Inc. by Order 2001-11-11 authorizing it to engage in interstate scheduled air transportation of persons, property, and mail.
