Air Pacific Limited seeks an exemption from the requirements of section 402 of the Act to permit it to offer and provide service between Nadi, Fiji and Toronto, Canada via Honolulu, Hawaii, through a code share/blocked space arrangement with Canadian Airlines International Ltd. Pursuant to an agreement with Canadian, Air Pacific will operate one weekly service between Nadi, Fiji, and Honolulu using its own aircraft. Air Pacific will place its code on Canadian flights between Honolulu and Toronto and Honolulu and Vancouver and will purchase a block of seats on the Canadian flights.

This exemption was granted by Order 97-12-22 and is scheduled to expire on November 19, 1998. Air Pacific also requests that this exemption authority be consolidated and made coextensive with the exemption authority granted by the Department on October 5, 1998 in order to provide services on the following route structure: Nadi, Fiji via intermediate points Auckland, New Zealand and/or Honolulu, to Los Angeles, Vancouver, Canada and Toronto, Canada as co-terminal points.

Air Pacific's Fiji and New Zealand service is important because Hawaii is one of the most geographically isolated land masses in the world and air service links are critical to Hawaii's economy. The trade and tourist industries comprise the foundation of Hawaii's economy, and both industries are uniquely dependent on international air service. Air Pacific's Nadi and Auckland services provide Hawaii with enhanced air service and generate millions of dollars in trade and tourist revenue, bolstering Hawaii's economy.

Air Pacific requests renewal of this exemption authority for a period of at least two years.  In the December 2, 1998 Notice of Action Taken, the Department consolidated Air Pacific's exemption authority to provide service between Nadi, Fiji and Los Angeles via Honolulu and Auckland, New Zealand with its exemption authority to conduct service between Nadi, Fiji and Toronto, Canada via Honolulu.

Air Pacific Limited, in accordance with the provisions of Section 416 of the Federal Aviation Act of 1958, as amended, 49 U.S.C. 40109(c), and Subpart C of the Department's Rules of Practice, 14 C.F.R. 302.301 et seq., hereby requests renewal of its exemption authority to provide international air transportation between Nadi, Fiji, and the two U.S. coterminal points Los Angeles and Honolulu via Auckland, New Zealand, and beyond the two U.S. coterminal points to, and from, the two Canadian coterminal points Toronto and Vancouver, Canada.

By Notice of Action Taken on July 6, 2006 in Docket OST-1997-2828, the Department granted Air Pacific an exemption from 49 U.S.C. 41301 to enable it to conduct scheduled combination services between Nadi, Fiji, and the two U.S. coterminal points Los Angeles and Honolulu via Auckland, New Zealand, and beyond the two U.S. coterminal points to, and from, the two Canadian coterminal points Toronto and Vancouver, Canada. Air Pacific's exemption authority would expire on July 6,2007 absent this renewal application. Air Pacific requests renewal of its exemption for at least a one year period under its existing terms and conditions.
