Rural Air Fare Study (Data Requirements)

We also need to obtain data for passengers whose reservations/tickets are issued by the carrier's own reservation system rather than through a CRS accessible to travel agents and other outside parties. Some carriers utilize CRS's as hosts for their internal reservation systems. Others utilize free-standing reservation/ticketing systems. Those carriers that utilize CRS's as hosts may either submit the data directly to our contractor (in a TCN format) or may submit it through their CRS and then ATPCO in the same manner that data for reservations/ tickets will be submitted for passengers booked outside the carrier's internal reservation system. Our contractor will have to work individually with carriers that do not utilize a CRS for their internal reservation system to develop a procedure and format for their submission of data. In either case, carriers are responsible for ensuring that data for their internal systems are provided to complement the data from the normal CRS data.

Motion for Confidentiality of Trans World Airlines
By Order 97-7-27, the Department has required all airlines to provide Ticket Control Number (TCN) data to the Department for use in the Rural Air Fare Study. The data will be collected from each carrier's CRS, and provided to a consultant for the Department by Airline Tariff Publishing Co. (ATPCO). In its order, the Department indicated that it would maintain all TCN data on a confidential basis if a carrier so moved, except for five specific data elements. TWA hereby moves, pursuant to the order, that all data in its TCN records other than those data elements be kept confidential by the Department.

Answer of Continental Airlines
As TWA has shown, the TCN records required by Order 97-7-27 contain highly confidential data elements which should be withheld from public disclosure under the standards of Rule 39 and the Freedom of Information Act. The Department has already said in Order 97-7-27 that it intends to grant confidential treatment to all data other than origin, destination, connecting points, carrier and fare data. (Order 97-7-27 at 3) To avoid the waste of time and resources occasioned by considering separate Rule 39 motions by all entities listed on Appendix A of Order 97-7-27, the Department should grant blanket confidential treatment to all when it acts on TWA's Rule 39 motion.

Airlines

Public Disclosure
The Department has ordered United to provide certain data relating to domestic passengers as part of the Rural Air Fare Study. Order 97-7-27. The data being requested are broader than those now reported pursuant to the Department's O&D Survey. The Department has directed that requests for confidential treatment of this data must be made pursuant to 14 C. F. R. 302.39.

We have decided to grant confidential treatment to all TCN record fields that may be submitted by carriers or CRS's in response to our requirements in Order 97-7-27 other than the origin, destination, intermediate points, carrier and fare. The information covered by this confidential treatment decision is financial or commercial in nature and will be obtained from persons outside the government. We further find that disclosure of the information is likely to cause substantial harm to the competitive position of the persons from whom the information will be obtained and that the information is not usually released to the public.9 This information is closely held by the parties to protect their business interests and could be used by others for sensitive competitive and marketing purposes.

Motion of Southwest Airlines for Confidential
Treatment
Southwest Airlines Co. (Southwest) is filing this motion in order to ensure that the confidentiality of proprietary data that Southwest is submitting in connection with the Department's Rural Air Fare Study is protected. By Order 97-2-27, the Department ordered all U.S. airlines to submit traffic and fare data with respect to their domestic passengers. That order noted that one way that carriers could comply with the data requirement would be to transmit Ticket Control Number (TCN) data which contained the required information. Order 97-2-27 also left open the possibility, however, that the required data could be submitted in a format or process other than TCN "in order to allow for greater accommodation to individual carrier circumstances and to minimize the cost and effort required." Order 97-2-27 at n. 11. Southwest does not generate TCN data, and accordingly it has arranged with the Department's contractor in this proceeding to supply the required data in an alternate, non-TCN format and process.

We have now determined that, as of December 1, 1998, an adequate amount of data has been collected. By this order, we are notifying all airlines and CRS's in Appendix A that we are concluding the data collection and relieving the participants of the requirements to continue to submit data as prescribed in Order 97-7-27.
