Delta Air Lines, Inc. and Transbrasil S/A Linhas Aereas (Exemptions and Statements of Authorization, US-Brazil Code-Sharing)

Delta and Transbrasil have recently entered into a reciprocal codesharing agreement that will allow each carrier to offer significantly enhanced online services between the United States and Brazil, by placing its code on flights operated by the other. These services are planned to begin on October 12,1997. In order to facilitate advance marketing and planning efforts, Delta and Transbrasil request that the Department approve this application by no later than August 8, 1997, to continue in effect for a period of at least two years.

Scheduled foreign air transportation of persons, property, and mail between a point or points in the United States, on the one hand, and Brasilia, Belo Horizonte, Curitiba, Florianopolis, Fortaleza, Manaus, Porto Alegre, Rio de Janeiro, Salvador and Sao Paulo, Brazil, on the other. Delta further request" authority to integrate this exemption with all of Delta's existing certificate and exemption authority, consistent with applicable international agreements Delta intends to operate this service under a code-share/blocked space agreement with Transbrazil S/A Linhas Aereas ("Transbrasil") on flights operated by Transbrazil, commencing October 12, 1997.
Display Transbrasil's "TR" designator code on flights operated by Delta in the following markets: Between Atlanta, on the one hand, and Sao Paulo and Rio de Janeiro, on the other hand; and on a blind-sector basis between Atlanta, on the one hand, and Boston, Chicago, Cincinnati, Dallas/Ft. Worth, Denver, Detroit, Log Angeles, and Lag Vegas, on the other, for carriage of Transbrasil's Brazil-U.S. traffic.

Relief requested: (1) Exemption under 49 U.S.C. 40109 to conduct scheduled foreign air transportation of persons, property and mail between a point or points in Brazil, on the one hand, and: Atlanta, Georgia; Boston, Massachusetts; Chicago, Illinois; Cincinnati, Ohio; Dallas/Fort Worth, Texas; Denver, Colorado; Detroit, Michigan; Los Angeles, California; and Las Vegas, Nevada, on the other, on a code-share basis. (2) Statement of authorization under 14 CFR Part 212 to display Delta Air Lines's designator code on flights operated by Transbrasil between: (a) Brasilia, Sao Paulo and Rio de Janeiro, Brazil, on the one hand, and Miami and Orlando, Florida, and New York, New York, on the other; (b) Brasilia and Sao Paulo, on the one hand, and Washington, D.C., on the other; (c) Sao Paulo, on the one hand, and Curitiba, Florianopolis, Fortaleza, and Porto Alegre, on the other; and (d) Brasilia, on the one hand, and Belo Horizonte, Manaus, and Salvador, on the other. The applicant requested that the authorities be granted for two years.

By code-sharing on each other's services, Delta and Transbrasil will be able to continue to offer increased service and competitive options to consumers traveling between the United States and Brazil. Continued approval of the Delta/Transbrasil arrangement is also consistent with the announced principles of U.S. international aviation policy and with previous Department approvals of similar cooperative arrangements.
