By this order, we tentatively select Delta Air Lines, Inc., Northwest Airlines, Inc., and United Air Lines, Inc., to serve Prague, and we tentatively allocate seven weekly frequencies to Delta, and fourteen weekly frequencies each to Northwest United for these carriers to conduct their service under code-sharing arrangements with third-country carriers.
We tentatively conclude that the proposals of Northwest, United, and Delta offer the greatest benefits to the traveling public due to the larger number of U. S. cities that would receive daily nonstop-to-nonstop connecting service to and from Prague with convenient connecting times at the intermediate point and should, therefore, be selected for the three available designations for third-country code-share services in the U.S.-Czech Republic market. Specifically, Northwest would provide daily same-day nonstop-to-nonstop connecting service via Amsterdam for twelve U. S. cities both eastbound to Prague and westbound from Prague. United would provide daily same-day nonstop-to-nonstop connecting service via Frankfort for ten U. S. cities both to and from Prague. Delta would provide daily same-day nonstop-to-nonstop connecting service via Zurich for eight U.S. cities both to and from Prague.

Comments of Northwest
Airlines in Support of Order to Show Cause 97-7-6
In reaching its tentative decision, the Department relied primarily on two criteria: (1) the number of U.S. gateways each carrier would serve on a nonstop-to-nonstop basis; and (2) the convenience of connections available at the intermediate point. SCO at 4. The Department's tentative conclusion that Northwest's proposal is superior in both respects is fully supported by the record. Moreover, yesterday Northwest and KLM announced that they intend to introduce daily nonstop service between Seattle and Amsterdam beginning April 5, 1998. With the addition of this new Seattle-Amsterdam service, Northwest will offer same-day nonstop-to-nonstop South Africa connecting service to a total of 13 different U.S. gateways, more than double the number of U.S. gateways that would receive such service under American's proposal.

Enclosed please find a revised copy of the Comments of Northwest Airlines, Inc. in Support of Order to Show Cause 97-76, filed in the above-captioned proceeding on July 11, 1997. Northwest submits this revision to correct an inadvertent reference to South Africa on page 2 of Northwest's July 11 pleading. As reflected in the attached revision, Northwest intended to refer to Prague, Czech Republic. No party will be prejudiced by acceptance of this Revision since Comments to the Order to Show Cause in this proceeding are not due until July 18, 1997.

The Department correctly determined that American Airlines, Inc. ("American") would offer the fewest benefits of any applicant. American does not have an integrated alliance with British Midland, and would offer poor quality connections over London Heathrow that do not match the seamless service offerings of Delta or the other applicants. American's proposal is further handicapped by the fact that it would not be able to offer any online service via its primary hub at Dallas/Ft. Worth. Thus, the Department correctly concluded that "taking into consideration the limited connecting service benefits provided under American's proposal, we are not persuaded that the presence of another carrier in the market outweighs the true service benefits available under the proposals of the other applicants in this proceeding. While Delta supports the overall determinations of the Show Cause Order, Delta is disappointed with the Department's determination to award Delta only seven frequencies.

Neither Northwest nor Delta in their comments objects to the tentative decision, and no other party filed any objection before the due date. In these circumstances, United urges the Department to proceed immediately to issue an order making final the tentative findings and conclusions in Order 97-7-8.
Immediate issuance of such an order is warranted without awaiting the due date for answers (August 1, 1997). This will enable the carriers selected to offer U.S.-Czech Republic thirdcountry code-share services to proceed immediately with plans to implement such services by September 1, 1997, when these services become effective under the U.S./Czech Republic agreement. Expedited action is consistent with the Department's policy of assuring that valuable economic opportunities available under international agreements do not go unused.

Files this contingent application, pursuant to 49 U.S.C.
§§ 41102 and 41108 and Subpart B of the Department's Rules of Practice in
Proceedings, for renewal of its Certificate of Public Convenience and Necessity
for Route 744, which authorizes Delta "to engage in foreign air
transportation of persons, property, and mail: Between
a point or points in the United States, the intermediate point, Zurich,
Switzerland, and the terminal point Prague, Czech Republic." This
certificate was issued by Order 97-8-24 in the U.S.-Czech Republic Third-Country
Code-Share Opportunities proceeding for a five year term expiring August 26,
2002.
Based on current Department policy and precedent, Delta believes that its Czech Republic certificate authority in Route 616, segment 3, when combined with its broad integration authority, permits Delta to provide, inter alia, third country codeshare service between the United States and Prague. Nevertheless, Delta is requesting renewal of its Route 744 certificate out of an abundance of caution. In the event the Department determines that renewal of this certificate would duplicate Delta's existing Czech Republic authority, Delta would be amenable to the Department's dismissal of this application. Otherwise, Delta requests renewal of its Prague certificate authority for an indefinite period in light of the fact that there are no codesharing, frequency or designation limitations on service to the Czech Republic.
