Operational and traffic flow requirements require a change in UPS's Mexico service pattern. This change will not result in UPS's serving any new cities; however, the service pattern change will result in service between new city pairs. Accordingly, UPS is required to file for an amended certificate adding these new city pairs and is requesting this exemption so that it may change its service pattern promptly.

Answer of DHL Airways

DHL Airways, Inc. has no objection to the application of United Parcel Service Co. for exemption authority to provide all-cargo service between San Antonio and Mexico City and between Houston and Guadalajara, provided that, as UPS requests, the U.S. Government first obtains the agreement of the Mexican Government to the designation of a second U.S. all-cargo carrier in the Houston-Guadalajara city-pair market. As UPS correctly notes, DHL is currently providing scheduled all-cargo service in this market, Order 96-11-24, and intends to continue to do so.

Notice of Action

Scheduled foreign air transportation of property and mail between (1) San Antonio, Texas, and Mexico City, Mexico, and (2) Houston, Texas, and Guadalajara, Mexico. UPS also requested authority to integrate service over these routes with its existing Mexico authority.

DHL Airways, Inc., is designated and serves the Houston-Guadalejara market—currently a singledesignation route under the U.S.-Mexico Air Transport Agreement. We have deferred action on UPS' request to serve the Houston-Guadalejara market while we attempt to obtain, from the Mexican aviation authorities, approval for double-designation services on the route.

On July 30, 1997, we orally granted the San Antonio-Mexico City portion of UPS' application (Order 97-8-17), and deferred action on the Houston-Guadalajara request. At the time UPS filed its application, the Houston-Guadalajara market was a single-designation route under the U.S.-Mexico Air Transport Agreement (DHL Airways, Inc., is currently designated and serves the route). We subsequently obtained approval from the Mexican aviation authorities for double-designation services on the route, making it possible to grant UPS' request for exemption authority to serve the Houston-Guadalajara route. With this action, no issues remain outstanding in Docket OST-97-2627.
