When the demand justifies additional scheduled service, Atlas would provide such service with B-747 freighter aircraft.

Although Atlas currently is not operating scheduled U.S.-Hong Kong service, it has utilized the rights in the past and is seriously considering providing new service in the market with B-747 freighter aircraft. Consequently, it desires to renew the exemption authority.  Authority granted permits it to engage in scheduled foreign air transportation of property and mail between New York, New York, Chicago, Illinois, Los Angeles, California, Anchorage, Alaska and Honolulu, Hawaii, on the one hand, and Hong Kong, on the other hand, via intermediate points in Taiwan and Korea. Atlas Air requests that the exemption be renewed for an additional period of two years.

Until recently, Atlas has been operating U.S.-Hong Kong service three times weekly serving Chicago, Los Angeles and New York via an intermediate stop in Seoul, Korea. Atlas expects to resume service in these markets when warranted by traffic conditions so it is interested in continuing the exemption authority.

By Notice of Action Taken, dated August 19, 1993 and confirmed by Order 93-10-6, the Department granted Atlas Air an exemption to engage in scheduled foreign air transportation of property and mail between New York, Chicago, Los Angeles, Anchorage, and Honolulu, on the one hand, and Hong Kong, on the other, via intermediate points in Taiwan and the Republic of Korea. This authority was last renewed by Notice of Action Taken, dated June 22, 1999. The exemption does not authorize the carriage of local traffic between Hong Kong, on the one hand, and Korea and Taiwan, on the other, and is set to expire June 22, 2001.

Atlas recently underwent some management and ownership changes and provided pertinent information with respect thereto to the Department. On March 21, 2001, the Office of Aviation Analysis advised Atlas that its review of those changes had been completed satisfactorily. Thus, Atlas continues to be a citizen of the U.S. and it continues to be fit to engage in air transportation. With regard to financial fitness, in 2000 Atlas earned operating income of $232.7 million on revenues of $790.5 million compared to $187.5 operating profit on $637.1 million in revenue during 1999. Net income increased from $53.3 million in 1999 to $85.3 in 2000. Its current fleet consists of 12 B-747-400, 20 B-747-200, and 3 B-747-300 freighter aircraft.

Requests two-year renewal of its exemption authorizing it to engage in scheduled foreign air transportation of property and mail between New York, Chicago, Los Angeles, Anchorage and Honolulu, on the one hand, and Hong Kong, on the other, via intermediate points in Taiwan and Korea (without local traffic rights between Taiwan and Korea, on the one hand, and Hong Kong, on the other). Atlas also requests that the exemption include the right to integrate that authority with its other certificate and exemption authorities.

On November 5, 2002, Atlas filed a request in Docket OST-02-13761 for broader exemption authority and the assignment of 5th freedom frequencies to take advantage of rights recently made available under the aviation agreement between Hong Kong and the United States. That request is under consideration in Docket OST-02­14049, the 2002/2003 Hong Kong Fifth-Freedom All-Cargo Frequency Proceeding.  Because the Department has not yet acted on the application in Docket OST­02-13761, Atlas wishes to renew its Hong Kong authority in Docket OST-97-2591 in order to have the flexibility to offer service in markets and over routings that make commercial sense.

Requests two-year renewal of its exemption authorizing it to engage in scheduled foreign air transportation of property and mail between New York, Chicago, Los Angeles, Anchorage and Honolulu, on the one hand, and Hong Kong, on the other, via intermediate points in Taiwan and Korea (without local traffic rights between Taiwan and Korea, on the one hand, and Hong Kong, on the other), and to integrate that authority with its other certificate and exemption authorities.

Atlas serves Hong Kong from time to time and wishes to retain its ability to do so when it determines service to be in its commercial interest.  Renewal is in the public interest because it will promote the expansion of service options for the shipping public.  The authority remains consistent with the open all-cargo regime in 3rd and 4th freedom markets between the United States and Hong Kong.
