Consolidated Answer of United Air Lines
The U.S.-Brazil Air Transport Agreement, as amended in 1996, explicitly authorizes code-sharing arrangements between designated airlines of the two countries. The United/VARIG and American/TAM proposals are consistent with the bilateral agreement. Both should be approved, in furtherance of the Department's international air transportation policy that encourages code-sharing alliances as being in the public interest, especially where such alliances are able to compete with each other. United has no objection to approval of the American/TAM applications so long as its earlier filed joint application with VARIG is approved no later than those of American/TAM.

We dismissed, without prejudice, each carrier's application (American and TAM) to the extent it requested broad authority to code share between other points on both carriers' authorized routes, as mutually agreed upon, and to the extent it requested authority between any U.S. point and any Brazilian point listed in their joint application without specifically indicating how such code-share services would be conducted.

In OST-97-2419, initially granted by Order 97-9-29, September 24, 1997, American holds authority to serve from the United States to Cuiaba, Curitiba, Florianapolis, Fortaleza, Foz do Iguacu, Goiania, Joinville, Natal, Ribeirao Preto, and Vitoria, Brazil, and the right to integrate such authority with its U.S.-South America (Route 389) and other U.S.-Brazil exemption authority, for purposes of a codesharing arrangement between American and TAM-Transportes Aereos Meridionais, S.A.
American also notes that it has two pending certificate applications for broad U.S.-Brazil authority, one in Docket 48301, filed on August 18, 1992, and the other in Docket 48343 (renewal and realignment of Route 398), filed on September 10, 1992. There were no answers in opposition to either of those applications with respect to Brazil, and each remains pending. American urges the Department to act expeditiously on these longstanding applications.

Answer of United Air Lines to Application of American for Renewal and Amendment Exemptions
United Air Lines, Inc. submits the following answer to the above captioned application of American Airlines, Inc.:
1. By its application, American seeks renewal and amendment of its exemptions to serve Brazil directly and pursuant to its code-share with TAM. United filed an application for renewal and amendment of its similar exemptions to serve Brazil in Dockets OST-1996-1346 and 1997-2358 on November 4, 2005.
2. In both eases, the carriers seek an amendment to include code-share authority to serve points in Brazil that is coextensive with that available under the U.S.-Brazil bilateral air services agreement.
3. United has no objection to the approval of American's application so long as United's own pending application for similar authority, including its request for amendment, is granted no later than American's application.
