Polar Air Cargo has yet to receive the foreign government approvals that it needs in order to begin the scheduled service. For that reason, it requests an exemption from the provisions of that order so as to extend by an additional 45 days the period during which it must commence service.

By Order 97-1-17 the Department granted Polar Air Cargo exemption authority to provide scheduled all-cargo service in the U.S.-Philippine market. That authority was subject to the condition that Polar Air inaugurate service within 90 days from the issue date of the order (January 24, 1997) or the authority would expire. On March 25, 1997, Polar applied for an exemption to extend its April 24, 1997, startup date to June 8, 1997. By Notice of Action Taken dated April 21, 1997, the Department granted the extension. Polar seeks extension of the June 8 startup date to July 23, 1997. Polar states that it has not received the necessary authorizations from the foreign government but believes that such authorizations will be obtained by July 23, 1997.

Polar Air unfortunately finds it necessary, for reasons beyond its control, to request a further 30 day extension of the period in which it is required to commence scheduled all-cargo services at Manila. Polar Air's application for appropriate authorizations in the Philippines has been pending before the Philippine Civil Aeronautics Board for some time. It was finally to be voted on at yesterday's meeting of that body. Polar Air had received informal assurances from Philippines government officials that they considered the application to be complete and noncontroversial, and that Polar Air could anticipate routine approval." Polar Air's application was set as the 16th item on the agenda for the Board's meeting.
For reasons which are unclear, the Civil Aeronautics Board adjourned its meeting prior to reaching item 16, meaning action on Polar Air's application will be deferred until the next meeting, two weeks hence. Polar Air immediately requested assistance from the U.S. Embassy staff in Manila to see if consideration could be expedited, but as of yet, their efforts have not succeeded.

By Notices of Action Taken dated April 21 and May 30, 1997, the Department granted the extensions (Order 97-6-16). Polar seeks extension of the July 23 startup date to August 23, 1997. Polar believes that grant of the necessary approvals by the Philippine authorities is imminent and the appropriate authority should be secured by August 23, 1997.

Although Polar Air had received informal assurances from Philippines government officials that they considered the application to be complete, non-controversial, and that Polar Air could anticipate routine approval, Polar Air has yet to receive such approval.
According to reports in the Manila press,2 Philippine Airlines is objecting to Polar's entry into the Manila market allegedly in retaliation for the Federal Aviation Administration's designation of the Philippines as a Category 2 country. As the Department is aware, both DOT officials and officials from the Department of State are working through our Embassy in Manila to resolve this matter. Polar Air expects to receive the necessary Philippine authority shortly and anticipates commencing Manila service by September 22, 1997.

That authority will remain in effect for two years, provided that Polar Air inaugurates service within 90 days from the issuance of Order 97-1-17. Polar Air had been granted an extension of the start-up date until September 22, 1997. Polar Air unfortunately finds it necessary, for reasons beyond its control, to request a further 120-day extension of the period in which it is required to commence scheduled all-cargo services at Manila. Polar Air's application for appropriate authorizations in the Philippines has been pending before the Philippine Civil Aeronautics Board for some time. Although Polar Air had received repeated informal assurances from Philippines government officials that they considered the application to be complete, non-controversial, and that Polar Air could anticipate routine approval, Polar Air has yet to receive such approval.
According to reports, the delay in processing Polar Air's application is allegedly retaliation for the Federal Aviation Administration's designation of the Philippines as a Category 2 country.

to Renew Exemption
On December 24, 1997, the Philippines Air Transport Office ("PATO"), which is reviewing Polar Air's application for Philippine operating rights, requested additional, highly technical information relating to Polar Air's "Operations Specifications." On January 5, 1998, Polar Air, through its attorneys in Manila, responded to PATO's December 24 communication with a detailed submission of the materials requested. Polar Air also requested expeditious action on issuance of its final permit so that it could start service on or before January 20, 1998.

Application to Renew Exemption
Given the unusual political and commercial factors that continue to affect its application and start-up, Polar Air therefore requests that its exemption be extended for an additional 60 days. Polar Air is now targeting March 29, 1998, for the start of service to coincide with the start of the Summer Operating Season. This should also provide more than adequate time for the new personnel at PATO to review and approve Polar Air's application. However, given past experience and the lack of any encouraging estimates from the Philippines as to the completion of its review process, Polar Air is requesting a 60-day extension in order to avoid the need to submit repetitious exemption applications as the final decision date by PATO slips further into the future.
