Order

The captioned applicants seek grant, renewal, and/or amendment of certificates of public convenience and necessity under section 4 l l 02 of Title 49 of the United States Code. The applications are fully described in the attachments to this order. Because the public convenience and necessity bases for granting these applications are clear, and the applications are not controversial, it is appropriate to use this simplified, Subpart Q procedure to grant the requested authority.

Federal Express currently holds certificate authority to provide scheduled all-cargo service between the U.S. and China pursuant to its Certificate for Route 638, which was most recently renewed and reissued to Federal Express for a five­year term expiring on November 17, 2002 by Order 97-10-8, served October 16, 1997. The route description in Federal Express's Certificate for Route 638 was subsequently amended to conform to the liberalized scope of all-cargo route authority and traffic rights available to U.S. carriers pursuant to the September 17, 1980 Civil Air Transport Services Agreement between the United States and China, as amended (the 1980 Agreement) by Order 99-2-8, served February 11, 1999, in Docket OST-97-3089. Order 99-2-8 did not alter the November 17, 2002 expiration date established by Order 97-10-8.

At the present time, Federal Express operates eleven all-cargo flights a week between the U.S. and China, utilizing MD-1 1 freighter aircraft having a payload capacity of approximately 193,600 pounds and Airbus A-310 freighter aircraft having a payload capacity of approximately 81,000 pounds. Those flights are operated between various gateways and Federal Express hub airports in the United States and the cities of Beijing, Shanghai and Shenzhen in China, via intermediate points and to beyond points, over the eastbound and westbound routings set forth in Exhibit FEC-100, infra. The all­cargo service operated by Federal Express between the United States and China links China to the major air freight sorting and flight operations hubs of Federal Express in San Francisco, Newark, Indianapolis and Memphis, and to the major Asia Pacific hub of Federal Express at Subic Bay in the Philippines. That flight network enables Federal Express to provide air express and expedited air freight service between the major cities of China and the entire United States, and between China and points throughout the worldwide operations of Federal Express.

Federal Express anticipates that it will make no immediate changes in its existing U.S.- China flight schedules following the grant of this application, although Federal Express anticipates that it will expand its total flight operations serving China when and if additional U.S.-China all-cargo operating frequencies are allocated to Federal Express in the future.

We amend or issue in the form attached, certificates of public convenience and necessity to the applicants listed in the caption of this order. We dismiss, as moot, the application of Polar Air Cargo to the extent that it seeks certificate authority to serve the Argentina and Grenada markets. We deny United's application in Docket OST-1997-2046 to the extent that it seeks to renew U.S-Brazil authority on segments 1 and 6 for an indefinite duration
